SATURDAY, 2, 1968 ALTON EVENING TELEGRAPH A4 Statute of Limitations Cited Vanpreter 9 Attorney Files Motion to Quash EDWARDSVILLE A motion to quash an indictment against East Alton, Mayor Charles Vanpreter alleged that the indictment exceeds the Illinois Statute of Limitations and is too vague for a proper defense. The motion was filed here Friday in circuit court by Attorney Francis Manning who is representing the Mayor both as private counsel and as village attorney. The motion states that the indictment exceeds the statute of limitations because the alleged offense took place on April 5, 1966, and the indictment was not returned until Feb. 5, 1968. More than the required 18 months had passed from the time of the alleged violation and the indictment's return by the grand jury, the motion said.

The second point of the motion to quash referred to the alleged vagueness of the indictment. The indictment bill charges that Vanpreter "committed the offense of misconduct for a municipal officer, in that he, being a municipal officer was interested indirectly, in a contract and business of a municipality. when the price and consideration of the con, tract and business was paid from the treasury of said municipality. Friday's motion to quash alleges that there are no grounds in the indictment for a proper defense. The indictment, the motion states, is "insufficient, indefinite and uncertain.
