Extent of public or governmental control of ATV's has been frequently debated. "So far as I know," Graves said, "the only law concerning use of the vehicle limits it to 'off road No law requires use of a helmet as with motorcycles; the argument apparently is related to the restriction of 'off road use' How can a helmet be mandated if vehicles are operated on private property? All-terrain vehicles are not toys, not safe for children," said Marilyn Graves, M. D. Graves, medical director of the Mississippi Children's Rehabilitation Center and on the Academy's committee on children with disabilities, said she and others concerned about children's safety want to prevent accidents. "As I see it," she said, "children should not ride all-terrain vehicles.

Operation of ATV's requires coordination, dynamic balance, quick reflexes, good visual and auditory preception and mature judgement. Children have not developed these skills." In three years, ATV's were related to 160 deaths and more than 100,000 injuries. Forty-six percent of these accidents involved users under age 16. "Can you imagine the public outcry if some 'dread disease' had caused, within a short six-month period, the deaths of six Mississippi children and was responsible for numerous disabling injuries," Graves asked? "Where is the public outcry against ATV's such an easily recognized, highly publicized, and preventable cause of mortality and morbidity in our children and young adults?" Graves and other health and safety experts emphasize that ATV's are "complicated, motorized machines," not toys. Marketed to hunters, farmers, and other sportsmen and outdoor workers, the vehicles are designed to travel rough terrain safely.

But proponents of ATV safety question whether anyone should feel totally comfortable about safety when using all-terrain vehicles. "The question of control for these popular and well-advertised vehicles is not easily resolved," Graves said. "I believe the manufacturer has definite responsibility for ensuring the safe design of the vehicle and for educating the public in proper use. ciask.
