in Missouri A RMbJIe Missouri Bar CONTRACT WITH MINORS QUESTION: Can a minor under 21 years fae sued if he misrepresents his age to obtain a loan? FACTS: Elvis Sideburn, a year old boy, wanted to buy a car. Being short of cash, he went 10 Company to borrow $1000.00 to purchase the auto. He knew the company would not make him a loan if they found out he was under age, so he told WHAT'S ALL THE EXCITEMENT? The I Coat Cora van; coming your Ij way! I WATCH FOR 17 I AT WARDS WARDS years old. Easymoney did not ask him for any identification or check his story at all, but simply loaned him the money. Elvis then bought the car, but two days later he ran it into a bridge and wrecked it beyond repair.

Since his car was gone Elvis decided that there wasn't any point in him repaying the loan. The Finance Company then sued Elvis, claiming that it was damaged in the amount of S1000.00, plus interest, by Elvis' misrepresentations. The boy's attorney, of course, answered that since he under 21, he couldn't be sued for breaching the contract with the Finance Company. DECISION: Elvis lost. The Appellate Court held that if a per-1 scr.

years of age mis-1 represents his age in order to induce an adult to enter into a contract with him, then he is liable for the amount which; the adult loses by reason the misrepresentation. More-: over, the adult is not under any duty to investigate and see if! the minor is telling the truth; about his age. CITATION: Royal Finance Co. v. i Schaefer.
