Newberg, lawyer, father, activist by Kurt Heine Daily News Staff Writer Lawyer Herbert B. Newberg could have booked his life with blocks of $300-an-hour time. He could have lived off his reputation as the man who wrote the book on class-action litigation. Or he could have stuck to the lecture circuit, sharing the secrets of suing on behalf of many.

But Herb Newberg, husband of State Rep. Babette Josephs, crammed more than that into his busy life. When he added his causes and concerns everything from world peace and nuclear arms control to civil rights and the education of his son and daughter he ended up with little time for himself, unless you count the hour he liked to spend daily working out at a gym. The gentle, soft-spoken man with such mastery of his legal specialty that colleagues called him "Professor" died Saturday at a wedding reception in Albany, N.Y.

He was 54 and lived in Center City. His widow, a Democrat who represents Philadelphia's 182nd District, had been married to him for three decades. "He believed very deeply in world peace," said Babette Josephs, 51. "He also was intensely involved in neighborhood crime-prevention. He was very optimistic that these things would happen.

He was very optimistic and very sweet and gentle and nice." Newberg was nationally known for his skills in class-action litigation the specialty of suing on behalf of a group of similarly affected plaintiffs. In 1977, his treatise, Newberg on Class Actions, was published in five volumes. The second edition came out in 1985. He was working on a third edition. His expertise made him in demand.

He lectured widely to legal associations, was a prolific writer of professional journal articles and was never too busy for a few words of advice to a young lawyer. "He taught me a lot," said Sandra L. Duggan, a partner in his law firm, Kronfeld, Newberg and Duggan. "His door was always open, no matter how busy he Newberg and Josephs met in the summer of 1960, when they were counselors at Camp Music Trail in New York's Adirondack Mountains. She was 18; he was 20.

Both wanted to become lawyers. They dated all summer. They fell in love. Then she went back to Queens College in New York. He, already a summa cum laude graduate of the University of Pennsylvania's Wharton School, returned to Harvard Law School.

Josephs, a native New Yorker, turned to teaching English at West Philadelphia High School. Their son, Lee, was born in 1964; daughter, Elisa, in 1966. Newberg dedicated himself to fatherhood with the same zeal destined to make him a legal star later in life. "He was a very loving father, very forgiving and said Josephs. They taught their children the traditional liberal values that founded America.

It must have worked. Elisa Newberg, at age 17, got the idea to sue the Philadelphia School Board when it declined her admission to all-male Central High School. Encouraged by her parents, she and two other girls prevailed. They ended the last vestige of sexual segregation in public secondary schools here. As their children grew, Newberg devoted more of his time to his work and to the social ills he wanted to help cure.

He founded the Philadelphia chapter of Lawyers Alliance for Nuclear Arms Control, now called Lawyers Alliance for World Security, and received the organization's first annual peace award in 1988. He was active in a long list of organizations, including the Trial Lawyers for Public Justice Foundation, Philadelphia Lawyers for Volunteer Action Program, Philadelphia Law Coordinating Center, National Panel of Arbitrators of the American Arbitration Association, American Law Institute, American Civil Liberties Union, American Jewish Committee, Community Legal Services and Philadelphia Jobs for Peace. His growing fame in the field of class-action litigation made him a courtroom star. Lawyers across the country sought his testimony in class cases on matters ranging from civil rights and welfare to employment discrimination. People who had been wronged sought him as their lawyer.

He represented thousands of women suffering health problems from the Dalkon Shield intra-uterine device, was working on behalf of about 35,000 operators of schools against asbestos manufacturers and helped force the cleanup of the Exxon Valdez oil spill in Alaska. He said this to a Philadelphia Inquirer reporter in 1985, about his work for world peace: "My personal situation is totally impossible. have a national law practice, I am the author of a multi-volume class action treatise, my rate is more than $200 an hour, and I travel extensively. But the busiest people have the most time. I don't have time.
