The initial operation would be near the Blue Bend Recreation Area, about 15 miles from White Sulphur Springs. 'We would have no jurisdic- tion over limestone operations," David' Callahan, deputy director of Natural Resources, said to- day. "However, limestone oper ations never have caused much of a problem from re- sources management view." that any i ore mining "probably would be surface mines, and we 1 have jurisdiction over that." Callahan said that no firm has applied for a surface mining permit in that area.

The De partment of Natural Resources was given jurisdiction surface mining under the strip mining bill passed by the 1967 Legislature. A recom- mendation to the secretary of the Army for a decision will not be made for at least a month, board Chairman Albert J. Es- gain said.

The panel was told that the major, decorated for gallantry and outstanding leadership in the Civil War, is now a forgotten man, dishonored on "flimsy" misconduct charges. The case was brought before the review board in the name of Charles Reno, 54. a New York City bartender, great grand AreQ a a nephew of the major. He asked; became an unpopular figure, as a result-of a "big lie" told in'the press about Custer's "Last Stand," in which a small force of 500 soldiers was massacred by an overwhelming band; of Sioux Indians on June 25,1876. The major, Walton said, was unfairly accused of acting; in cowardly fashion and failing to come to defense.

But Walton said Reno acted quite properly. Custer had command of three of his four battalions at the bat- tle and all were wiped out. Reno led the fourth battalion of 112 soldiers split off from Custer's main force and 49 were killed when attacked by another Sioux force. Walton said Reno's decisions resulted in saving the few men who survived. He said Reno felt he could not leave his wounded to the Indians and go to.

Custer's aid and his troops were almost out of ammunition. Reno, born in 1835 and a grad- uate of West Point, lived out his life after his discharge from the Army in 1880 as a government clerk in Washington. He died of cancer in 1891. the board to show Maj. Reno honorably discharged, and to al- low his body to be removed from his unmarked Washing- ton, B.C., grave to the Custer National Park in Montana.

One Reno defender before the board was George Walton of Wrightsville, N.C., a retired colonel who is the author of a book that seeks to exonerate Reno, titled "Faint the Trumpet Sounds." He told the board that Reno Is Near Normal KEYSER-The local weather station reported 1.76 inches of moisture measured for April. Normal for April is 3.03 inches. During April 1966, the area re- ceived 4.25 inches. Total amount of moisture for 1967 is 10.54 inches. Normal for this period is 10.71.
