For the past several months, the group has been trying to engage borough council in a discussion about the issue at the board's public meetings. Usually, the council just listens. "It's not for the common good, it's for commercial gain. It's wrong," said resident Mary Ziegler, one of six residents who spoke during the Jan. 22 council meeting.

"There are other business establishments that the tenant can occupy, you don't have to take this man's property," said another resident, Maryann Cot-trell. "Who will benefit from this taking? It doesn't help anyone other than that person," she continued, referring to Jennifer Stachiotti. Resident Patricia Herrschaft said about 140 residents have signed a petition opposing the borough's actions. "They are appalled and disgusted," she told the council, referring to the signatories. "Glassboro people do care.

Last year, Glassboro offered Arifi a better deal: a borough-owned duplex at 15 Wilmer St. and $50,000, a package that the municipality says is worth $250,000.

Arifi rejected both offers, saying either one would be a step down for him. The triplex taken by the borough generated about $32,000 per year in gross rental income, he said, and also served as his home. The hearing on the merits of the eminent domain taking is scheduled to be heard in Superior Court in Woodbury before Judge Georgia M. Curio at 9 a.m. Thursday.

Court briefs have been filed by both sides. There may be oral arguments, according to Thatcher. Arifi and his lawyer aren't the only ones who believe that the borough has acted unjustly. A small but vocal band of residents supports Arifi. The group says the borough's actions violate the principles of eminent domain which permit the taking of private property but only when the public is the primary beneficiary, such as when a road is improved, or a hospital is built in an area that eery store.

Glassboro police responded to the incident on Jan. 19 when Arifi, 77, and Tom Stachiotti, 47, of Clayton exchanged words. Arifi filed charges of making terroristic threats, harassment and disorderly conduct against Stachiotti. Stachiotti, whose wife, Jennifer, operates Turning Heads Salon in the triplex, also filed charges, accusing Arifi of harassment. That issue started in March, when Glassboro used its eminent domain powers to take Ari-fi's triplex with a plan to sell the building to the Stachiottis.

Jennifer Stachiotti originally leased the space for her salon from Arifi. In the past, Jennifer Stachiotti has complained to the borough about the condition of the property under Arifi's ownership, saying that code violations make the building ineligible to receive a borough grant for facade improvement. Glassboro wants Arifi to accept $152,300 for the property, an amount that has been determined to be fair market value according to an appraisal ordered by the borough in September.
