The bill will be sent to the Court of Appeals for argument, possibly this month. AVhit- temore, convicted of first degree murder for the slaying of Robert H. The first takes issue against the acceptance by Judge O'Dunne of a juror who said he knew Holtzman, the slain guard, 25 years ago. The second exception is against the manner of the court in inquiring as to the past history of jurors, and the third deals with the action of Judge O'Dunne in having one of the jurors already accepted step out of the box for further questioning.
