But John Blakely, attorneys for the Twiggs, said the court should not allow a hypothetical custody trial. Even if custody or visitation rights are denied to the Twiggs, Blakely said they still are entitled to know whether Kimberly is their daughter "so they can end the search for their child, learn the present circumstances of their child, be available when needed, provide family medical histories." Arlena, the child raised by the Twiggs, died last August after heart surgery.

Blood tests performed earlier showed Arlena could not have been the Twiggs' biological daughter.
