Mitchell Ponders Law In City Gambling Case County Judge Mitchell has a lot of law to consider this weekend in connection with a fairly unusual hearing involving three men charged with lottery and bookmaking at a city restaurant last March. Both Stephen Gretzkowski, assistant county prosecutor, and the two attorneys for the total of six defendants were citing a bevy of cases on "search and seizure" at the conclusion of the state's case. Judge Mitchell will keep the motions under advisement until the hearing is concluded Monday.

No Warrant The case was sent to Judge Mitchell from the city's Municipal Court before there was a hearing there. Attorneys for the six men Bid Denied For Mt. Holly Radio License WASHINGTON (UPD)-A Communication Commission hearing examiner yesterday recommended that the application of the Mount Holly-Burlington Broadcasting Co. to operate station W.J.JZ in Mount Holly be denied. The application was opposed by the Burlington Broadcasting which sought the same outlet in Burlington.

Burlington Broadcasting took the case to court after the commission denied its application on June 12, 1963. Later the court ordered more hearings, the result of which came out today in the report of examiner Jay A. Kyle. Should the commission agree with Kyle's recommendation, it would then take up the disposition of Burlington Broadcasting's application. EDWARD F.

FISHER. ($32.00) Township Clerk, contended that the evidence seized March 2 in a raid at the Roma Cafe. 600 S. 3rd was illegal as it was obtained without a search warrant. Their motion to suppress the evidence was sent to Judge Mitchell for determination.

If he allows the evidence, the case then will go back to Muncipal Court. Because some of the facts in the case are disputed, the hearing has all the earmarks of a trial. Both the prosecutor and the defense will be presenting all their witnesses testimony. Charged with lottery and bookmaking are Frank Anthony DiRenzo, 45, of Mount Ephraim; Americo Cerasaro, 40, of the 5000 Edwards Penryauken, and Gabriel Curiale, 39. of the 400 block 4th Bellmawr.

Held as material witnesses were Victor Verna, 44, of the 600 block S. 3rd Alfred Colangelo, 51, of the 1300 block Dayton and Thomas DiRenzo, 39. of the 7000 block Rudderow Pennsauken. Gretzkowski said the case is involved because the law on "search and seizure" is constantly changing. He said other attorneys always are particularly interested when this type of hearing arises, because the procedure is not specifically established.

Gretzkowski's arguments on the motions included a contention that Cerasaro, owner of the cafe, had signed a liquor license which stipulates that police officers have the right to search the establishment. He also alleged that the policemen had "probable cause" to make the arrests and seizure of evidence. Can't Sign Away However, the attorneys for the defendants contended that no man can sign away his constitutional rights. Judge Mitchell appeared particularly interested in the license question and asked both sides to submit cases supporting their positions. The policemen, Set.

Donald E. McGlensey and Dets. Clemente Queiroz and George Sahlin, testified they first grew suspicious when they saw Frank DiRenzo standing in front of the Roma with another man, making notations in a small book. When they went inside the cafe, they said they confiscated numbers plays and other records and took numbers plays over telephones. Det.

Queiroz testified that when he picked up one of several notebooks in Frank DiRenzo's possession. DiRenzo said: "That's not what you are looking for-that's for my loan shark business."
