Mcfia chief-, tain Thomas (Tom ny Ryan Eboli kept a rendezvous with death on a dark Brooklyn street early Sunday. He was shot five times in the face from a passing truck as he sat alone at thu wheel of his Cadillac, apparently -waiting to keep an appointment with one of his underworld peers.

Eboli, 61, was boss of the i Cosa Nostra family once headed by the late crime czar Vito Genovese. Since Gen-: ovese's death in 1569, Eboli lost many of his nob "sol-; diets" and severay of his lu-: crative rackets to rival gangs. DETECTIVES srid they i plari to question Carlo Gambi-' no. "boss of bosses," of the American Mafia and the one who stood to benefit most by Eboli's death, and Albert (kid Eboli had lost much of the crime empire he inherited from Genovese. But he was still prosperous.

He recently purchased a mansion in Fort Lee, N.J., and was trying to acquire a hotel in the Catskill resort area, hoping to set up a gambling casino there when and if the state legalized this form of gambling. So far as police know, Eboli was not involved in the 1971 shooting of Brooklyn mob boss Joe Colombo or the recent rubout of Crazy Joe Gallo. However, a mob informer identified an old Eboli henchman, Joseph (Joe Yak) Ya-covelli, as the man who ordered Gallo's execution. And another Eboli pal, Carmine (Sonny Pinto) Di-Biase, is being sought. He was named as one of the two gunmen who blasted Gallo in a Little clam Jiouse.

The killers abandoned the panel truck a block away. A short distance from the truck, police found a 1965 sedan with an unfired loaded submachine gun in a zippered case on the front seat. The panel truck was stolen Saturday while parked in Greenwich Village. Police said the car also was stolen and its New Jersey license plates were stolen from another car in Newark. President Nixon will return to Washington this week for a between-the-conventions battle with the Democratic Congress that will help define the domestic campaign issues. The focus will be on Federal spending, budget deficits, taxes, inflation and busing. To put the spending issues in perspective, the President is considering a special message or speech explaining his concern over the threat to his budget. HITHERTO he has focused on specific spending proposals and used the threat of a veto to try to persuade Congress to trim its sails.

Now he is discussing with aides a statement giving his overall view of the budget problem and his belief that if he loses the battle in Congress, there will be higher taxes or more inflation, or both. In short, he would charge that Democrats are making higher taxes inevitable and threatening the price stability he has been fighting to achieve. One White House aide is preparing an analysis of the cost of all pending bills that might be passed this year and their impact on the economy. If the President decides to speak out on ie whole problem, his statement would be based on this study. 20201. JESSUP, Md. (UPI) he was "a peace-loving man," Maryland Gov. Marvin Mandel on Sunday ended a 10-hour disturbance by 200 prisoners at the Maryland House of Correction by agreeing to meet with inmate representatives. "We were not going to have a repeat here of what happened up in New York," Man-del said, referring to the uprising in Attica State Prison last year in which 43 persons were killed by State Police retaking the prison.

AS MORE THAN 300 riot-geared police stood by, Man-del told Col. Thomas Smith, State Police superintendent: "I am a peace-loving man. Let's talk to them instead." During the disorder, two guards and four inmates were injured and rampaging prisoners caused damage estimated in the hundreds of thousands of dollars. They set several fires and smashed windows and furniture. The inmates returned to their cells after an angry confrontation between Mandel and the prisoners, separated by two chainlink fences only five yards apart in the rear of the prison.

Metropolitan Demetrius, a progressive who became an archbishop only five months ago, was elected Sunday to succeed Athenagoras I as patriarch of the Christian Orthodox Church. He won an overwhelming majority, 12 votes to 3 for Metropolitan Nicholas, after the Turkish government, seeking to keep the Patriarchate under its control, had struck the name of Metropolitan Mel-iton, the outspoken progressive favorite, from the list of acceptable candidates. The 15 members of the Holy Synod chose Demetrius, archbishop of Imbros and Tene-dos, after a brief service in which they stodd around the altar of St. George's Church were unarmed, but several weapons were found in the yard later.

Mandel and Mitchell supervised the placement of the prisoners back in the cells and then they met for 30 minutes with 18 inmate representatives. The two officials said they would look into gripes about food, medical services and guard harassment. Shortly after dinner Saturday, a group of about 60 inmates tried to escape by scaling the 20-foot fence that later was to be the site of negotiations with Mandel. A guard at the rear tower opened fire with a shotgun and four persons were hit, including a guard inside the yard. ANGERED BY the shooting, inmates began their rampage and succeeded in taking over the large six-story building and prison yard.

Billowing smoke could be seen from two miles away and two dozen pieces of fire-fighting equipment sped to the scene. At midnight, State Police cleared one wing of the U-shaped building. "The inside is badly damaged. It will take quite a while to bring the prison to full service," Mandel said. The minimum-security facility is located 15 miles southwest of Baltimore.
