10.. Philadelphia Inquirer -NJ C7 Death Notices Death Notices Death Notices OBITUARY J.T. McDermott, a tough justice who had a soft spot for literature Th. said Family Court Judge Jerome A. Zaleski, a longtime friend.

No visit with the justice was complete, Zaleski said, without a few minutes of poetry recitation. "He was an incredible memorizer of poetry and Shakespeare," said Merv Sneath, a friend of 40 years. "He could quote for an hour without looking at notes. I could start a poem by Edwin Arlington Robinson, and he would finish it." Justice McDermott's mother was an actress, and her son inherited a dramatic flair. As a young man, he occasionally wore a cape.

In recent years, the tall, distinguished-looking jurist was easily recognizable on the streets, wearing a big cowboy hat. But his daily work clothes were, like his legal views, conservative and consistent. The grandson of a Philadelphia police captain, Justice McDermott was a lifelong supporter of the police. He sympathized with the dangers of their work. He believed in the importance of police in maintaining an orderly society.

And he backed the men and women in blue from the bench. As a trial judge from 1965 to 1981, Justice McDermott dished out so many maximum sentences to criminals convicted in his court that he became known as Philadelphia's "hanging judge." It was a label he enjoyed, and sometimes boasted about. In homicide cases, he imposed the death sentence 13 times. And as a Supreme Court justice, he voted to uphold the legality of the death penalty. He voted consistently to strengthen the law in favor of police.

In one ruling in 1985, he held that a dog barking in the night gave patrolling police officers sufficient reason to stop and frisk two men coming from an alley. But outside the courtroom, those who knew him said, Justice McDermott was kind and supportive to all. "He balanced being a human being and a Supreme Court justice very well," said Kathy Radwanski, Justice brother, Benedict of Havertown, and five sisters, Louise Tappata of Wildwood Crest, Ann DeRosa of Philadelphia, Phyllis Amendt of Seaville, Angie Cellini of Philadelphia and Diana lannucci of Laurel Springs. Int. Grewsmount Com. McDermott's personal secretary for 13 years. "He treated us in the office as friends." He was a devoted father and raised his children alone after the death of his wife, the former Mary Theresa Bradley, in 1974. Witty and eloquent, he spent much of his early adult life in the pursuit of public office.

He was one of the rising stars of the city's Republican Party in the 1950s and 1960s. He ran as a GOP candidate for Congress in 1958, for City Council in 1962 and for mayor in 1963. He lost each contest. But two years after his mayoral run against James H.J. Tate, Justice McDermott, at 38, was named a judge of Common Pleas Court by then-Gov.

William Scranton. When he became a Supreme Court justice in 1981, Mr.Justice McDermott reached the pinnacle of his career. It was a position in which he took great pride. "People referred to him and he loved to hear this as Lord High Justice McDermott," Merv Sneath said. "He enjoyed the limelight." Justice McDermott was bitterly offended in 1983 when The Inquirer published a series of articles raising questions about his ethical conduct and that of other Supreme Court justices.

He sued the newspaper and, in 1990, won a $6 million verdict when a jury found that the original publication was truthful but that he had been libeled by a reprint of the series. Both sides are appealing the verdict. Justice McDermott is survived by his sons, James, John, Thomas, Michael and Matthew; a daughter, Suzanne Cunningham; one sister, and sight grandchildren. Stuart Ditzen INQIIKKKSTAFP WRITEK He was given to clothes that set him apart capes, bow ties and cowboy hats. He could quote poetry by the hour, and speak authoritatively on William Shakespeare and Samuel Johnson.

He was witty, charming and distinguished in appearance. But if you were a criminal, you were in serious trouble before him. For State Supreme Court Justice James T. McDermott was a very tough judge. Justice McDermott, 65, died of an apparent heart attack Sunday at his Qtestnut Hill home.

He was a man who rose from humble beginnings in the neighborhood around Second and Vine Streets to educate himself, become a lawyer, gain appointment to Common Pleas Court and, ultimately, win election to the state Supreme Court. Justice McDermott, who was first elected to the high court in 1981, won a second 10-year term last year. Though he faced mandatory retirement in five years, he declared himself "in excellent health" last fall and said he was looking forward to continued work on the court. "After 41 years of daily preoccupation with the law," he said in October, "I believe I may yet have much to contribute." A son, James "Jamie" McDermott said Justice McDermott had failed to appear at a Father's Day dinner with five of his six children in Roxborough. When the family was unable to reach Justice McDermott by telephone, another son went to his home to investigate and found his father dead.

Friends spoke yesterday of the un common and colorful qualities that were Justice McDermott trademarks during his more than 30 years in public life in Philadelphia. He was a book collector, a student of history and a lover of poetry and literature. "He believed that judges should read as much literature as the law," South Jersey deaths ALBERT R.
