Chief Judge Richard 11 Chambers of the 9th U. S . l j o a.m. and 3 p.m. Monday Court of Appeals has set a through Friday and we will hearing for Friday in Tucson, (be glad to give you more lathe judge's home, on w h e t h e r j f o r m a t i o n on this volunteer the nine-man court should accept a full-dress appeal from the convict-author. George T. Davis, attorney for Chessman, Wednesday filed a letter to Chambers asserting that a memorandum issued by the judge had changed the nature of the hearing. Davis contended that the memorandum suggested that Chambers would c o n s i d e r arguments about the facts as well as purely legal arguments. It was for this reason Davis said, t h a t Chessman should be'permitted to attend. * * if K THE MEMORANDUM, issued earlier Wednesday to counsel, asked that certain portions from transcripts he brought to Tucson. In particular, it asked for testimony from two of Chessman's victims, Regina Johnson and Mary Alice Meza. Chessman has been on Death Row for 11 Yi years after conviction as the Los Angeles "red light bandit" on 17 counts of kidnaping, rape and robbery. Davis, however, also as sorted that the hearing shouk be held in San Francisco rath er than in Tucson because voluminous records and the attorneys are heie. But if the hearing is held in Tucson, Davis requested that all the records, documents and exhibits in the case be taken to Arizona so as to prevent any loss of time in case they are needed. Chessman has estimated that these documents would fill a small truck. need.
