Rep. E. C. Galhings, a Democrat and author of various bra- ccro bills, said in an interview the Labor Department "clearly exceeded its authority" when it ordered minimum wages set for 22 states last week. "The order ought lo be taken to court and tesled," Galhings said. "Congress has denied, specifically denied, the Labor Department the right to set minimum wages for farm workers." Gathings contended that the way in which the department set minimums for braceros would force minimums for' domestic workers first. By forcing them thus lo offer Ihe Mexican minimums lo domestics, a domestic minimum was set. "All the secretary has the authority to do is to see that Mexicans do not adversely affect the wages of domestic farm workers" Gathings said. "The preponderance of the evidence at the hearings showed they did not. "This means that the America! farmer won't hire as many Mex cans. It means he will have to mechanize more --and it means [hose braceros who came here to work and lived a prelly good life in Mexico off their earnings here will no longer receive those earnings." Gathings is a member of th House Agriculture Committee. He said he saw little hope this yeai of forcing the secretary of label to recall the minimum wage order through legislation. He cited the press of committee business on the main farm bill, the sugar bill and other agriculture measures which will take up the committee's time.
