FLORIDA TODAY, Sunday, August 14, 1988 11B Travel deals send couple on judicial system tour By Jane Musgrave FLORIDA TODAY TALLAHASSEE A Fort Myers couple who recently boasted in a magazine article that they mailed out 160,000 travel promotion postcards a week have been charged by state and federal officials with operating a scam. In a circuit court lawsuit filed in Lee County, Attorney General Bob Butterworth charged Robert and Mary Black with using false and deceptive advertising and stealing money from people who never went on the tours offered by Travel World International. In a separate suit, the Federal Trade Commission charged the couple with making false claims about vacation packages, billing customers who didn't want to go on their trips and not refunding money to people thoughout the nation who canceled the trips. U.S. District Court Judge William Castagna granted the federal agency's request for a temporary restraining order, prohibiting the couple from continuing to conduct business and freezing all of the company's assets. Circuit Court Judge Wallace Pack is to consider a similar state request on Aug. 19. The attorney general is asking that the couple never again be allowed to operate a travel agency. In addition, both agencies are seeking penalties against the Blacks and restitution for those who were bilked. Although exact figures were not available, penalties alone could cost the couple millions of dollars. Twice before, Butterworth's office had threatened to take legal action against the company, which has operated under several names, said Tina Fur-low, an assistant attorney general handling the case. In most cases, the Blacks offered three-day, four-night vacations for either $69.95 or $99.95, she said. In a statement of claim filed last week in Manitoba Court of Queen's Bench, 15 investors say they lost the FLORIDA NEWS money when an investment group sold the property without their knowledge. Some investors are out $100,000, depending on how many condomini um units they invested in through a $25,0OO-a-unit deal started in 1979. The group is suing George Heat-on of Hillsboro Beach, Fla.; Phil Kives, former head of K-Tel International; Max Serlin of Dominion Securities; G. David Greenberg, a Portage La Prairie, Manitoba, lawyer; and P and M Development Ltd. of Winnipeg for breach of contract and loss of their investments. The claim said the defendants transferred the condominiums to a limited partnership with Deerfield East Condominiums Associates-without the investors' knowledge. . ., The claim says George Heaton started entering into unspecified mortgage and sale transactions with , the condominiums in 1984.
