Smith gave no sign of emotion, beyond clasping and unclasping his hands as "he stood facing the jury box. Lipschutz then asked that the Jury be polled. McBride objected that the prosecutor had no authority to do so. The same thing had been done frequently in these courts and had never before been questioned, Lipschutz replied.

Both attorneys turned to the bench. "The Commonwealth has the same rights as the defendant," ruled Judge Milner. "Is that your desire, Mr. Lipschutz?" SEVERAL ARE PROMPTED Lipschutz replied that it was, and the jurors were polled. Several had to be prompted by Beaston to give their full verdict, including the penalty, but all concurred in Mrs.

Wiley's announcement. Judge Milner then announced he would defer sentence until a later date, and thanked the jurors, before dismissing them, for giving up their time in public service. McBride also thanked the Jurors for "a fine, honest verdict. Everyone," he added, "is satisfied with the Job that you did." "You would say that!" Lipschutz retorted glumly.
