"Jerry" Spivak, 55, a former owner of the trailblazing rock club the Electric Factory, died Oct. 5. He was also part owner of the H.A.

Winston Co. restaurant chain. Mr. Spivak was found dead of a selfinflicted gunshot wound about 3 p.m. Oct.

5, in a wooded area of Fairmount Park near his residence on Conshohocken Avenue, according to sources who asked not to be identified. A spokesman for the medical examiner's office said the death had been ruled a suicide. The Electric Factory, with its strobe lights, Day-Glo paint and "adult playground" with seesaws, jungle gym and sliding board, brought the sights and sounds of psychedelic rock-and-roll to Philadelphia in the late 1960s. The club opened Feb. 2, 1968, in the former Lee Tire warehouse at 22d and Arch Streets, with the Chambers Brothers.

In its heyday, it featured most of the top names in 1960s rock-and-roll, Deaths here Laurence E. Schmidt, 58, a retired engineer, died Friday at the CrozerChester Medical Center after a lengthy illness. He was a resident of Paoli for 30 years. Born in Marshfield, Mr. Schmidt received a master's degree in mathematics from Marquette University.

In 1 1983, he retired after 27 years of service with General Electric's Re-entry Space Division in Center City. He was a member of the Elfin Society, an engineers association, and a former manager of the Berwyn-Paoli Little League. Survivors: wife, Mary Ann Whetsel Schmidt; three sons, Stephen L. of David M. of Houston and Jeffrey J.

of Phoenixville; a stepson, Richard M. Hatton of Paoli; a stepdaughter, Nancy A. Hatton; mother, Dolly and a sister. Friends may call from 8:30 to 9:30 a.m. Tuesday at the Vincent C.

Alleva Funeral Home in Paoli. Mary A.C. Hagenbach, 28, a registered nurse, died of pneumonia Friday at Fitzgerald Mercy Hospital in Darby. She lived in Drexel Hill. member of the Pennsylvania Nurses' Association, Miss Hagenbach was employed at Crozer-Chester Medical Center's burn unit.

She had previously worked in the pediatric intensive care unit of Thomas Jefferson University Hospital and on a medical-surgical floor at Pennsylvania Hospital. A 1978 gradute of Neumann College in Aston, Miss Hagenbach served as student body vice president and was listed in the Who's Who Among Students in American Universities and Colleges in recognition of her achievements in student leadership and scholarship. She served on Neumann College's executive board for alumni affairs and was also active in alumni activities of Cardinal O'Hara High School in Springfield, which she attended from 1970 to 1974. Survivors: parents, Thomas E. and Julia Kennedy Hagenbach of Drexel Hill; brothers, Joseph and Thomas and sisters, Theresa and Ann.

Services: viewing 7 to 9 p.m. tomorrow and 9 a.m. Tuesday at Victor J. Ruffenach Funeral Home in Drexel Hill. Mass of Christian Burial, 10 a.m.

Tuesday at St. Dorothy's Church, Drexel Hill. Joseph T. Sullivan 2d, 76, a plastics manufacturer, died Thursday at his including Janis Joplin, Jimi Hendrix, Iron Butterfly, the Jefferson Airplane, Chicago, The Who, The Band, and Blood, Sweat and Tears. The Factory, which Spivak started with his brothers Herbert and Allen and promoter Larry Magid, was at the center of controversy in the late 1960s, as Police Commissioner Frank L.

Rizzo and Mayor James H.J. Tate battled unsuccessfully to shut it down. Rizzo and Tate contended that the psychedelic nightclub, which did not sell alcohol, was a nest of drug abuse and indecency and a nuisance to the neighborhood allegations that neighbors, as well as Mr. Spivak and his brothers, denied. The Factory, which had a capacity of 3,000, closed in November 1970 because it could not generate enough money to meet the demands of big-name groups, the owners said.

Mr. Spivak ran into still more official resistance to the 1969 Atlantic City Rock Festival, which he helped promote. The festival drew 112,000. "I think the politicians and police home in Huntingdon Valley after a brief illness. He was a graduate of Penn Charter High School in Germantown and Swarthmore College.

He engaged in various manufacturing enterprises, and he was an enthusiastic outdoorsman. Mr. Sullivan was a member of the Abington Friends Meeting and the Jenkintown Rotary Club. Survivors: wife, Margaret Maddock Sullivan; three daughters, Mary S. Fairbanks of South Carolina, Janet S.

Davis of Port Ludlow, and Meemie S. Steere of Huntingdon Valley; a son, Joseph T. 3d of Merrit Island, two grandchildren; three sisters, and one brother. Services: memorial 4 p.m. Saturday, at Abington Friends Meeting.

Clifford A. Harbaugh, 79, a Phila- delphia banker for 47 years, died Thursday the Harlee Manor Nursing Home in Springfield, Delaware County, after a long illness. He was a resident of Morton and had lived for many years in Springfield. A native of Philadelphia, Mr. Harbaugh began his banking career in 1922 with the Real Estate Trust now the Fidelity Bank.

Except for service with the Army Air Corps during World War II, he remained with the firm's 15th and Sansom Street office until his retirement in 1 1969 as an assistant vice president. Mr. Harbaugh was active in civic and veterans affairs and was a former chairman of the Pennsylvania Committee for the Crusade for Freedom, supporting Radio Free Europe. He also was past commander of the Philadelphia County Council of the American Legion and past commander of the United Veterans Council of Philadelphia. Mr.

Harbaugh received the distinguished service award from the Marine Corps League for volunteer work with the Toys For Tots campaign. Survivors: wife, Anne Dutcher Harbaugh; three sons, Clifford, Russell and George; nine grandchildren, and three great-grandchildren, Services: 11 a.m. tomorrow at the Spencer T. Videon Funeral Home, Garrett Road and Shadeland Avenue, Drexel Hill. Interment at Fernwood Cemetery, Upper Darby Township.

"If at a festival, where you had, say, 400,000 kids, one of the musicians said, 'All right, let's take it why, you wouldn't have any way to stop the human flow.

They could just march through the cities, and there wouldn't be any way to stop them. I think they are the wave of the future." Born in the Wynnefield section, Mr. Spivak got into the entertainment business through his father, who owned a few taprooms. The brothers learned the promotion business when they bought the Showboat, at 1409 Lombard which catered to a jazz audience. In the early 1970s, he and his brother Herb began a restaurant at Front and Chestnut Streets, where they served drinks and hamburgers.

It ultimately grew into the regional chain of H.A. Winston Co. restaurants. Mr. Spivak's son, Harry, said last night that his father remained active in the management of the restaurant chain, which has headquarters in Collingswood, N.J.

He also had financial interests in promoting musical events here, he said, but was no longer an active promoter. He is by his wife, Sally; three John and Joshua; survived, two daughters, Jenny and Betsy; two brothers, and one sister. Graveside services were held last week.
