Clerk of City CounciL AN ORDINANCE autiorize the creation of a refunding loan or loans In the sum or two million four hundred thousand (2.400.000) dollars, the proceeds thereof to be used for the redemption and payment of bonds of the City of Philadelphia Issued on July 26, i22, pursuant to the provisiona ot an ordin ince approved June 24, 1922.

Sectlim 1. The Council of the City of Philade phia ordains. That the Mayor, City Control er and City Solicitor, or any two of them, fce and they are hereby authorized to borrow at auch time or times, and in auch port on, as In their Judgment the best interest of the City demand, from the highest bidder or bidders by advertisement, not In than par. on the faith and credit the City of Philadelphia, a sum or sums which the aggregate shall not exceed two million four hundred thousand (2.400,000) dollars, to be expended aa provided In Section 2 cf this ordinance. Sect.

2. The moneys raised by the loan -loan authorized by the first section of this ordinance shall be used for the following to wit: To redeem and pay the bonds issued July 26. 1922, pursuant to the authortation contained in the ordinance of June 24. 1922, which issue aggregated three million (3,000,000 dollars: Provided, however, that all moneys for the redemption the issue of bonds hereby proposed and directed to be refunded placed In the sinking fun I shall first applied to the payment, as far as applicable, of the principal sue! bonds and the balance of such Issue only shall be redeemed by the Issue new bonds. Sect.

3. Interest on said loan or loans a rate not exceeding that provided by law shell be paid by the City of Philadelphia half-yearly on the first days of the months of January and July at the office the fiscal agent of the City of Philadelphia. The principal ot aaid loan or luara shall be divided Into twenty-four series each lr; the sum of approximately one twenty-fourth of the total sum borrowed at any om time. That the Cramn Shipbui ding Company be and Is hereby authorised to temporarily enclose the followirg described portion of Cumberland street ii the City of Philadelphia, to wit: aii u.ai certain piece or ground situated tn the Eighteenth Ward of the City of Philadelphia, described as follows: Beginning at the point of Intersection formed by the southwest side ot Cumberland stneet (one hundred and twenty feet wide) 1th the southeast side of Richmond street me hundred and twenty feet wide): extending south eighty-five degrees twenty-three minutes nine seconds east seventy five feet to a point In the bed ot Cumber and street, said point being distant sixty fe.t soutneast from the southeast side of Richmond street on a line measured at right argles thereto, and also being distant forty-five feet northeast from the southwest si-ie of Cumberland street on a line measured at right angles thereto: thence extendi! south forty-eight degrees thirty minutei nrty-seven seconds east tnree hundred and seventy feet more or less to a point: fienee extendine in a westerly direc tion for y-eight feet more or lesa to a point; extending south forty-one degrees twenty-nine minutes three seconds west twelve feet more or less to the southwest side of Cumberland street; thence extending norm lorty-eignt degrees thirty minutes fifty-se en seconds west three hundred and ninety-three feet five and one-half inches to the sou heast side ot Richmond street, the first mentioned point and place of beginning. Being a portion of the bed of Cumberland street (-ne hundred and twenty feet wide) lying or- ine southwest side thereof ard extending from Richmond street to a point approxi Tiately four hundred and thirty feet southeast therefrom.

SECT. 2. The Director of Public Works oe Jnd ne is hereby authorized and directed to issue permits for the temporary enclosure of the nbove described portion of Cumber land sueet in (Jity 01 fnuadeipma for the duiation of the national emergency and for one year thereafter. SECT. 3.

The Cramp Shipbuilding Compary shall enter satisfactory security with the City Solicitor tn the form of a bond of five thousand (5.000) dollars to indemnity the City against any claim which may sr se as the result of the construction or maintenance of the above-mentioned enclosure, and to remove the same at the expirati of the permit at its own cost and expense and reconstruct the bed of Cumberland street to a condition as good as when the permit was Issued. SECT. 4. The Cramp Shipbuilding Compuy shall at all times so maintain its enclosui that access may be had to the said portion of Cumberland street by municipal mechanical equipment and for other municipal purposes, and shall at all times maintai a watchman 'at the entrance to the said enclosure to permit such Ingress or egress. SECT.

5. The Cramp Shipbuilding Compary shall at no time during the life ot the said permit Interfere In any way with municipal structures contained within the enclosui and shall permit the access for repair, enlarrement. extension or Improvement if the same at all reasonable hours. SECT. 6.

The Cramp Shinbu'lillm. Compary shall at all reasonable hours afford all public utility companies (ree access to the said enclosed portion ot Cumberland street for the purpose of inspecting or servicing public utility facilities com a 1 mo wiinin ine area. SECT. 7. Any permit Issued pursuant to this ord mance shall not authorize or permit the ere tion of any structure other than a standar i fence, gate and gate-house within the premises permitted to be enclosed, or to place any underground structures without the permission of the Department of Public Works.
