5049. The State of Missouri to the above named defendant, greeting: Now at this day comes the plaintiff in the above entitled cause, by attorney Leo H. Johnson, before the undersigned clerk of the circuit court of Newton county, Missouri, In vacation, and files, her petition and affidavit, stating among other things that the defendant is a non-resident of the State of Missouri and cannot be served with the ordinary process of law in this state. It is therefore ordered by said clerk, in vacation, that publication be made, notifying the said fendant that suit has been commenced' against him in the circuit court of Newton county, Missouri, the object and general nature of which is to secure a decree of divorce from defend' ant on the ground of indignities of such nature, as to render the plaintiff's condition intolerable, a'nd that unless you said defendant, be and appear at the next term of the said court to commence and be holden at the court, house in Noosho in said county, on the first Monday in June, 1926, and on or before the first day of said term, answer or demur to the plaintiff's petition, the same will be taken as confessed and judgment rendered accordingly. It is further ordered that aitoopy hereof be published at least once a week for four weeks successively, the last insertion to be at least 30 days before the first day of said term, in The Neosho Times, a weekly newspaper regularly published in said county and designated by the plaintiff as most likely to give notice to sal.d defendant.

C. Coulter, trust officer for First National Bank, Neosho, Missouri, executor of the estate of J. M. Z. F. Barnes, deceased, of Wm. Richardson, deceased, and of George H.

Eddy, deceased, and that said petition contains as full, correct and complete a recital and description of the claims of said deefndants. both known and -unknown, and how derived as the same are known to the plaintiffs. That in substance plaintiffs allege that the claims of said unknown defendants are obtained and derived by, through, or under the said known defendants and the instruments, conveyances, and entries appearing of public record as in said petition described and herein above set forth. Plaintiffs further alleging that they are the absolute owners of said real property, in fee simple, holding the same against the claims of all persons whomsoever, including the known and unknown defendants. S.
