The car made a right. We started running after it and it sped up." The pair waited for two hours in the parking lot and by the hospital, waiting for Scott to return.

Cecil Hicks ordered his deputies Friday to refrain from using their job titles "in any public manner except as required by the discharge of your official duties." The order stemmed from a citizen's complaint about a deputy district attorney who authorized use of his name and title on an llth-hour mailer sent to voters on behalf of attorney Arnold Mordkin. In last week's judicial contests, Mordkin ran an unsuccessful campaign against incumbent Municipal Court Judge Edward L.

Laird. The mailer involved a letter that was printed on a letterhead similar to official district attorney's office stationery, and was signed by prosecutor James Brooks. The letter claimed that Mordkin had "proven" that Laird engaged in plea bargaining, among other practices. A group of more than 20 deputy district attorneys signed a petition condemning what Brooks had done. Friday, Hicks disclosed that Brooks was almost fired for his conduct.

In a letter to the citizen who had complained. Hicks wrote: "The (Brooks) letter is deceptive and the made-up seal on the envelope and letterhead is repulsive. In my view, it was designed to mislead the public into believing that it originated in my office. It did not originate in my office! "It was my intention to terminate the deputy for this conduct. I have been advised by the county that I cannot." Brooks has claimed he had nothing to do with the way the letter was designed and used.

In a memo to his staff, Hicks said "The title and authority 'Deputy District Attorney' are derivative. They derive from my appointment and I will not accept the use of the title in any way that reflects adversely on our ethics and integrity." After ordering the deputies not to use the title except for official duties, Hicks' memo admonished the staff to get approval from management before using the deputy title for making speeches or other activities.
