It is well understood that on Wednesday evening the 25th a delegation of workingmen (instigated it is said by the Kearney of these Islands, Moreno) visited the Palace and expressed to the King their satisfaction in the present Cabinet, and also that in theirf opinion the country would in no way be damaged or set back its future prosperity under their administration.

It is also understood that after such assurances, which no doubt were soothing in the extreme, speeches were made by the Ministers and others gathered within the Palace walls for the occasion. An argument was made by some one, in favor of the' $10,000,000 and among the points mentioned endeavoring to show that the country could stand and pay the loan, the following1 extraordinary figures were given, We bring 1,000,000 Chinamen here, oa landing the tax (hospital would amount to two milon dollars, tbe next year' the- tax' would amount to five million dollars, thus leaving only a balance of three millions cn the loan," provided the above mentioned taxes were appropriated for that purpose and neither could beat present, except, by. special legislation. Such absolutism as, he advocated would lead, most directly to a loss of the independence of the Government. Mr. Kapena seems to have forgotten that this is not an absolute despotism, but a Constitutional monarchy, which has been established upon the increased intelligence of the people of the Islands, and that our independence has been 'acknowledged and guaranteed, only upon' this basis. And for Mr.

Kapena or any other man to go back upon this record and advise or uphold acts of despotism is to jeopardise our independence. 'And this for the simple reason that such acts are unconstitutional, and will not be i submitted to by an intelligent people, who have rights in their premises, and who deBire peace and and a stable, honest administration not one of caprice and senseless And it can well be imagined that no advisers of the King are so dangerous to the independence of this Government as those who advocate and justify, as it is understood Mr. Kapena to have done, the recent acts which have excited the universal condemnation of the whole coon try. Wiser councillors are needed. to guide the ship of state through the breakers that will be sure to surround her at times, and dangerous experiments may be tried once too often.

Referring to the extended statement of the facts of this case, and tbe law as established by the authority of Zupplein estate case, (III Ilaw- iiitivEep6rts 323) in the written opinion of the hief Justice in his nrst decision, it will De sum- cient to saj. 1.

Tbe transaction ol tne parties cannot be viewed as a compromise. The defendant had no right and no title. It is said in argument that being in he tnusfbe dispossessed, by a suit of ejectment, and that his' settlement wat therefore a compromise. But it is not to be inferred tbat.be would have resisted the occupation by the. plaintuTs when he' came to 'know that he had no title, and it is not to be sustained as a compromise that tbe plaintiffs should give up half of tbeir estate in order to avoid an action of ejectment the (tenant of! this half, who would hare no defense to set up and who must pay the costs.

Neither is it apparent what Pu.t-biki compromises when he only claims a half and is given all that and relinquishes nothing, unless making a partition of an estate is deemed a compromise. 2. It stands thea that the plaintiffs, without consideration, granted the defendant half of tbe estate, upon their view that he was entitled as tbe husband of a wife deceased without issue, and a brother aud the plaintifo, The 'statute subsisting in 18C8 being tnaf such a husband took nothing of the wife's real estate. The decision of tbe Court in the estate of Napua Zupplein Kaluahine must be conclusive.
