(Arrangements by Richard Rodgers? he kept America singing HAIG ers entered the Institute of Musical oj Sty Rodgers with leading ladies Ethel Merman (left), Mary Martin Born June 28, 1902, in Manhattan, he first played the piano when he was 4. His father, a well-to-do physician, and his mother were music aficionados who weaned their son on musical scores and classical composers.

He played songs by ear at age 6 and invented melodies at 9. He published his first song, "Auto Show Girl," piano was the result of hard wofk, concentration and good lyrics, which he was usually given first. "Inspiration with me isn't a matter of mood, but a matter of work and application," he said in a 60th birthday interview in 1962. "I don't need a piano to compose. I can create while walking, riding a cab or subway or sitting in a barbershop." Judge Merna Marshall, 46 From Inquirer Wire Strvica NEW YORK Richard Rodgers, whose music for "South Pacific," "The Sound of Music," "Oklahoma!" and other shows kept Americans humming for 60 years, died last night at his Manhattan home, a spokeswoman said.

He was 77. Alice Regensburg, a press agent who served the composer during his lifetime, said Rodgers died at 10:28 p.m. His family said he died of cancer after a lengthy illness. Rodger's wife, Dorothy, was present in the East Side home at the time of his death, Ms. Regensburg said.

Rodgers' was a rare, prolific talent, composing 43 stage musical scores (40 of them for Broadway) nine film scores, four television scores and assorted other works. Over the last 60 years, many of his more than 1,000 songs most written in collaboration with lyricist Lorenz Hart and later with Oscar Hammerstein II have become classics. "All I really want to do is to provide a hard-working man in the blouse business with a method of expressing himself," Rodgers once said. "If he likes a tune, he can whistle it, and it will make his life happier." The titles prove it: "Some Enchanted Evening," "People Will Say We're in Love," "Climb Every Mountain," "My Funny Valentine," "Bewitched, Bothered and Bewildered," "Oh, What A Beautiful Morning," "Falling in Love With Love," "Musicians don't usually like to recognize contemporaries," one authority said in 1951, "but Rodgers' songs are already considered as a page of musical history." His songs sweet, sentimental, sophisticated, vampy or inspirational endure. The catchy tunes, haunting melodies and refrains have always sent theater-goers home humming a lingering phrase or two.

A critic once described Rodgers' music as "so simple we often forget how good it is." Describing once how he managed to write consistent hits, Rodgers once said: "I have an almost religious faith in what an audience wants and what it is willing to accept. "I think they want to see a good show. They want to be moved, to be captured. And I don't think they care very much what it is that captures them." His work was awesome not only in volume but in scope. The man who wrote "Surrey With the Fringe on Top" also composed the score for the Emmy Award-winning television series "Victory at Sea" and ballet music for "Slaughter on Tenth Avenue." The compositions are so smooth that many were led to believe no effort was involved in their creation.

Indeed, the speed with which he wrote some of his classics is legendary "Bali Ha'i" in five minutes, "Happy Talk" in 20 minutes, "It Might as Well Be Spring" in 60 minutes. He produced the full score of "Oklahoma!" in three days. "When you hand him a lyric, get out of his way!" Hammerstein once said. But Rodgers said his fluidity at the i.uiMi.i.m. i 'IS Art, now Juilliard School of Music, where he studied music theory while collaborating with Hart on numerous amateur productions.

They wrote their first professional score, "Poor Little Ritz Girl," in 1920. But it was not until "The Garrick Gaieties" in 1925 that the duo began a successful career that included 28 stage musicals, one night club revue and eight film musicals. Their hits' included "Dearest Enemy," "On Your Toes," "Pal "The Boys From Syracuse." But it was during his 18-year partnership with Hammerstein that Rodgers tasted his sweetest successes. They were often called the Bob-bsey Twins of Broadway and the, Gilbert and Sullivan of the American musical theater. After Hammerstein's death in 1960, Rodgers composed the scores for four stage productions, including "Do I Hear a Waltz," with lyricist Stephen Sondheim, and "No Strings," the only play for which he wrote both music and lyrics.

latest stage production, a musical adaptation of the 1944 play "I Remember Mama," opened in 1979 and was short-lived. Rodgers' personal life was a far cry from the fanfare of Broadway. He was a calm, uncomplicated person with a simple lifestyle, and was said to be shy and nervous when playing his songs for the first time. Married in March 1930 to Dorothy Feiner, Rodgers was a devoted family man, father of two daughters and a grandfather. In addition to his Manhattan residence on Madison Avenue, he kept a summer house in Fairfield, where he played his only sport croquet.

alter fm Judge Marshall and former U.N. in 1958 and returned to her native city. From 1961 until her appointment to the bench 10 years later, she was an assistant U.S. attorney in Philadelphia, successfully prosecuting a series of bankruptcy fraud cases brought by the Kennedy administration. She headed the office's claims division here and was a member of its selective service division for prosecution of draft dodgers.

In 1966, her work brought her the "Young Federal Lawyer of the Year" award presented annually by the Federal Bar Association. She was the first woman to be so hondred. Judge Marshall's major skirmish with city and state government began in 1975, when she ordered the empaneling of a special grand jury to investigate various allegations of corruption. A year later, state legislators, including several under investigation, cut off funds to the special prosecutor's office directing the grand jury inquiry. Judge Marshall called the action an infringement of "the court's inherent right to convene a grand jury," and turned over the 1920, upon his debut On his way to 1,000 tunes when he was IS.

At 17, he became the first freshman at Columbia University to compose the score for the annual Columbia Varsity show. Hart, then a recent Columbia graduate, provided the lyrics for the show, launching a partnership that began with their meeting when Rodgers was still in high school and ended when Hart died in 1942. "When I met him," Rodgers once said, "I acquired in one afternoon a career, a partner and a best friend." After two years at Columbia, Rodg- envoy Andrew Young in 1978 grand jury's evidence to the U.S. Attorney's office. Several of the legislators were indicted and convicted.

Judge Marshall was a national council member and past president of the Federal Bar Association, and in 1970 was named deputy chairwoman of the organization's' National Commission on Criminal Law. She belonged to the Philadelphia and Pennsylvania bar assocations and taught criminal law at Temple University law school in 1972. She was appointed to the Pennsylvania Sentencing Commission, an 11-member body responsible for sentencing standards, early this year. In addition to her legal duties, Judge Marshall was a member of the Jewish Community Relations Council and the Golda Meir chapter of Hadassah. She is survived by her husband, Joseph H.

By Stephan Salisbury Inquirer Sutl Writer Judge Merna B. Marshall, who was appointed to Common Pleas Court by former Gov. Shapp in 1971 and was a thorn in Mayor Rizzo's side ever since, died Sunday at the Hospital of the University of Pennsylvania after suffering from leukemia. She was 46 and lived at 3900 Ford Road in the city's Wynnefield section. Civic and professional groups noted Judge Marshall's impartiality on the bench and praised her campaigns against corruption in city government.

Rizzo was so irritated by what he considered her "mollycoddling" that in 1973, just days before the election, he released a controversial "computer study" that purported to show that she had a lenient sentencing record, which Rizzo contended made her one of the four "worst" judges in Philadelphia. "I consider myself a good judge, neither harsh nor lenient," Judge Marshall said at the time. "I am a judge, not a computer. If you wanted computers (to decide cases) you wouldn't need judges." The voters apparently agreed. She was elected to a full 10-year term.

A lifelong Philadelphia resident, she was graduated from West Philadelphia High School in 1951 and the University of Pennsylvania in 1955. She taught fourth grade at the Evans School in Yeadon in 1955 and 1956 before heading to Boston University law school. She received a law degree l-il I 1 i I i i i i i i i mis SKI, W. E.
