from her late residence. 2208 An important decision on the question of the statute of limitations for debt was handed down by Justice Porter in the Superior Court yesterday, in reversing the decision of the Common Pleas Court of Huntingdon count in the ease of D. M. Cloyd vs. II.

P. Keynolds, and awarding a jury trial. In January, i902, Cloyd delivered to Reynolds, it was testified, at Dublin, a stallion colt to be sold at the latter's place in Huntingdon county, for a price that would bring Cloyd the full sum of $5K) and whatever part of the profits over that sum as should be mutually satisfactory. It was agreed, it was said, in case of death of the colt while being transported, Reynolds 'as rot to be held responsible for the The evidence established that Reynolds sold the horse on Februarv 4, 1902, to Trexlcr Brothers, for $700. Cloyd did not bring suit to recover the price of the horse until April 9, 1908.

The lower court held that the statute of limitations was a bar to his claim, and entered a compulsory non-suit. Cloyd testified at the trial that Keynolds never told him the horse had been sold. He also offered letters written, it is said, by Reynolds, which were intended to lead him to believe that the horse had been killed, and that Reynolds had sueci the railroad company. The lower court excluded these letters.
