But in all the cases, he added, "the accused police were required to undertake added burden of personal legal representation in their own behalf, at their own expense." 421 COMPLAINTS The mayor contrasted 421 complaints handled by the Police Advisory Board in 1935 through 1967, in which only 71 were heard and 19 resulted in recommendations for disciplinary action, with 301 complaints handled by the Police Board of Inquiry in which 85 were heard and 76 resulted in conviction and punishment, including 30 dismissals.

"The record of the Phila-delphia police department is unparalleled throughout the nation," the mayor said. "We should strive to keep it so, without imposing impossible legal procedural burdens on the policemen on duty, who is prepared to protect the lives and property of 'all' at the peril of his own life. The mayor said the police department has a "firm, written policy that all complaints, including those that are anonymous, be investigated." He said complainants had other avenues open to them as well, including his Office for Information and Complaints, the Commission on Human Relations, the Civil Service Commission. the U. S.

Department of Justice, the Philadelphia district attorney, the state attorney general and state and Federal courts. JUDGE REVERSED Mercer Tate, who had revived the board against the mayor's wishes last June when the State Supreme Court reversed a ruling by Judge Leo Weinrott abolishing it, said the mayor had reacted to pressures brought by Rizzo and John Harrington, Fraternal Order of Police president. He also said Tate had "ignored the very significant and. important positions of a large number of individuals and responsible agencies" in favor of the board. CONFIDENCE OF PUBLIC He said the mayor's statistics were correct but his conclusions were wrong because he ignored the board's deterrent effect on policemen who would do wrong and the confidence it gave the public in the law-enforcement program.

The mayor sent Mercer Tate, who is not related, a 2Vi-page letter which said the board had become outdated and inadequate and "under present circumstances, actually provokes, rather than erases, tensions in our city. 6 Are Promoted Ai Miami Herald MIAMI, Dec. 22 (AP). H. J.

Kndght, John's brother, becomes chairman of the board and is succeeded as president by Alvah H.

Dr. Shedd's proposed cuts would end driver training, remedial physical education and Saturday programs. He proposed that evening school education and recreation activities be consolidated into 36 public schools instead of the present 189 with a saving of $200,000. School extension activities would be eliminated on Saturdays, Sundays and holidays. Saturday music program sessions would be reduced and all sessions would be cut by one-half hour but the AH-Phila-d-elpfaia Elementary Boys Choir, the senior high choir and the senior high orchestra and 'band would be retained.

David Kirkpatrick, spokesman for the Pennsylvania State Education Association, said his organization maintain that most personnel scheduled for a salary cut have tenure and cannot have their salaries cut without their permission. He also called for an independent audit of the district. A majority of the speakers protested proposed elimination of driver education course, remedial physical education and extracurricular activities. WILL RETAIN CHOIR David Horowitz, deputy superintendent for instruction, announced that the district will retain the All-Philadelphia Elementary Boys Choir and the senior high school choir, orchestra and band.
