B. Cox lor plaintiff. W.C Harris lor defendant. Keeent 'ifiasrrl iim The Crand jury Malto Ir'eiitHieiit to the t'ourt nbout of CoraT of Quarter Bes-sions Judce Ludlow. The Court was engaged yesterday with theiiearint; of desertion cases, linal orders in several of which were made.

Baring-the afternoon the Grand Jury came in, and through their foreman made the follow-in; presentment in regard to the storage of petroleum: Ir esen tr; i 1. To the TTonorable the Judges of the Court of Oyer and Terminer and Quarter Sessions, Ac. The Grand Inquest of the Commonwealth of Pennsylvania, inquiring fr the citv and county of Philadelphia, re-soecttuilv present that it, is within their knowledge that large quantities of ietroleuni have been and are kept and stored within the closely-inhabited portions of the said citv. and that said accumulations of the material so highly inflammable and destructive in its character are dangerous to the lives and safety of the citii-ens inhabiting such neighborhoods. A disaster resulting from the storage of said material occurred on the morning of the 8ta causing an immense destruction of prooertv, and a loss of human life, iu the neighborhood "of Ninth and Washington streets, in said cit v.

petroleum was there stored in large quantities upon an elevated niece of ground, and, being on fire, ran down into the adjoining streets and among the houses, suddenly enveloping the entire neighborhood in llames. ami preventing the escape ot some of the inmates from their residences. The Grand Inquest have reason to apprehend that unless the protection which the law most assuredly affords be rendered, occurrences of like character may happen again in the community; and with a desire to evoke the action of the proper authorities, and lor the purpose of receiving further instructions as to their duties in the premises, respectfully present tnese facts lor the consideration of tho Court: In response to the presentment. Judge Ludlow said, substantially, that the Courts of Oyer and Terminer and Quarter Sessions undoubtedly possessed the power to protect the lives, liberty and property of the citizens of the Commonwealth whenever threatened; that in cases like this proceedings might be instituted either bvthe Grand Jurv of their own motion, or upon a ciiarge 01 the Court to t'ae Grand Jury, or by thedistrict .1 1 n.i,.li faro hn imk attorney. Who couiu my i.j..ir.o them their consideration.

In regard to the storage of netroleum in the built up portions ot the city, he Instructed the Grand Jury that while the mere storage of this article was not of itself an ofiense, yet that the improvident storing of an article so inflammable, in such manner and localities as to endanger tne lives and prooertv of is a nuisance at common law and an indictable ofiense of which the Grand In-o'nest could take cognisance. The judge in the course of his remarks referred to and commented upon adjudicated cases in point. MARINE IXTELLIGEXCS. IOKT Oi' Fob. 11.
