In the early 1890s, the Kerrville Cemetery Association was founded to help preserve it and keep it clean. Some time later Henry who was the mayor of Kerrville for three consecutive terms (from 1909 to 1915) and whom the street that runs past the front gates of the cemetery is named for, owned an adjoining property.

He managed to get a quick claim deed to the land on which the cemetery sat from a man who claimed to be related to the family who owned it. A quit claim deed one wherein the person holding the deed dOfesn't know for certain if he is the real owner of something, but says that if he is he will give it to whomever he gives the deed to. Remschel took the deed to the Kerrville Cemetery Association in the early 1890s, with the stipulation that no one be buried there ever again. However, this deed was effective for only a short time. Some of the people who had dead buried there decided to sue.

In volume of the 1897 district minutes, you can read that the judgement set aside the writ claim deed, as. well, as the deed that Hendry Remschel gave to the Kerrville Cemetery Association. The judgement also provided that the families of the people buried there would form a foundation that would take care of the cemetery, a foundation that also later folded up. In 1959, several members of the'Rodriguez family tried to figure out who would take care of it. With some help they got a charter, and finally got possession of the cemetery.

The original five who made up the organization that got the charter were Emmet and Mary Rodriguez, Manuel Ayala, Cruz Espinoza, and another man whose last name was Coleman. They and their family members have taken care of the cemetery ever since. Since then, they have turned it over to the Ayala family to take care of it and it has consequently become the responsibility of Maria Garza, the daughter of Manuel Ayala, one of the original five. She is therefore the representative of the succesors of the board members of the Mountainview Cemetery Association that has the official charter.
