Juco Tuition Jump Is Recommended TOPEKA (AP) The Kansas Legislative Council approved a report recommending higher tuition charges for Kansas junior colleges. The council also gave approval to a report by its Assessment and Taxation Committee that counties end boards of education of cities of the second and third classes be permitted to draw interest on idle funds. The junior college report was submitted by the council's edu- Committee. The Education Committee also recommended a -moratorium on approval of any new public junior colleges until after the 1969 legislative session, and an increase in state junior college aid. The Education Committee recommended the minimum tuition should be increased from $2.50 per credit hour to $4.

The committee recommended also that each community junior college charge a higher tuition rate for pupils who reside outside the community Junior college district than the rate charved those in the district. The total charges assessed against the counties; last year would have been reduced from $1.12 million to $584,000 under this proposal, the committee said. The committee recommended state aid be increased from $5.50 per credit hour to $8. This would be an increase of $062,500 over the present amount of aid. The Assessment and Taxation Committee report on idle fund interest would give the counties and boards of education for second and third class cities the same authority to draw interest as now provided unified school districts and other local units of government, except cities which can invest their idle funds under home rule powers. The committee recommended the state set guidelines for deposit of investment of idle funds and that counties be prohibited from investing or depositing funds received for distribution to other local units.

Pipe Line official testified that a contemplated merger with Kansas-Nebraska Natural Gas is no longer planned. James R. Whatley of Houston, senior vice president of Kaneb, made the statement in U.S. District Court here during the hearing on a Kansas-Nebraska request for a preliminary injunction to prevent Kaneb from attaining a merger by buying additional stock in Kaneb also asked the court to transfer the suit to Kansas City where a related anti-trust civil action is pending in federal district court.

Judge Robert Van Pelt said tie would hear testimony on both the request for the preliminary injunction and for the transfer before ruling on either. Whatley told the court that a merger had been considered a definite possibility when the Kaneb firm began to buy stock in Kansas Nebraska but no merger now is planned. Kansas-Nebraska contends hi the Lincoln suit that a "tender offer" made by Kaneb to buy stock violated the Securities and Exchange Act of 1934 as well as rules of the Securities Exchange Commission. Kansas Nebraska said the offer improperly implied that tba stock was sought only for investment purposes and not for merger purposes. The Kansas Nebraska attorney, Robert Martin of Wichita, argued that Kaneb used the tender offer to buy stock as a guise to a "raid" Kansas Nebraska and take control.
