SECTION 9. because of pending or threatened concerning any one or more parceis subject to assessment, the Mayor and Council and the winning bidder receive a written opinion of its bond counsel stating pending or threatened litigation creates a situation where bonds cannot be issued against certain parcel or parcels, the Mayor and Council may then order that the construction contract be modified to exclude from the applicable contract some of the work which will benefit the parcel or parcels in question.
