Just put a dome-shaped Manhattan skyscraper together and let the wind blow. Case in point: the 72-story City-spire.

Wind whipping around the louvered top of the building, 800 feet above the city streets, emits a high-pitched wail which echoes for blocks through Manhattan's concrete canyons, city officials said Friday. "From Third Avenue, down to the 40s, up to the 60s, over on the West Side the calls have come from all over," said Ian Matthews of the city Department of Environmental Conservation. "The callers said basically there's a noise, and it's driving me batty, and I don't know where it's coming from." On Wednesday, DEC investigators solved that last problem. After more than a month of searching, they zeroed in on the Cityspire at 150 W. 56th went up to the roof, and found the eight-sided dome was wailing away.

A summons was subsequently issued for violating the city noise control code. If the building is found guilty, a fine of $220 to $880 can be imposed. "With the right winds, it becomes a big whistle," said Matthews. "I don't know the acoustics, but it's a very loud, very big whistle. And if you lived in the neighborhood, it could drive you insane." Just ask Anthony Mazzola, the editor in chief of Harper's Bazaar who lives two blocks from the building.

THE PALACE THEATRE, 61 Atlantic Stamford Yorkers 'Your building's whistling' I mean, hey, come on," said Howard Hornstein, the lawyer for building developer Ian Bruce Eichner. Hornstein said his side is waiting for a copy of the complaint before responding, although architect Sam Saccia of the architecture firm Murphy-Jahn in Chicago believes the whistling if it exists can be stopped. The sound doesn't occur every day; the wind must be coming in at the right speed.

The largest number of complaints occurred around Veteran's Day, when the wind was gusting up to 30 mph, said Matthews. On Wednesday, the winds gusted to 23 mph. Reporters heard no buildings whistling on Friday, when the air was nearly calm. It's not the first time the Cityspire has drawn unwanted attention. When the building was completed, it stood 814 feet tall 11 feet above the city-imposed limit.

The ensuing controversy ended when developer Eichner agreed to construct more than 7,000 feet of dance space for non-profit groups in his building. Hornstein is beginning to wonder if it's all worth it. "The point is, first we had the height issue, now we've got the whistling building, and I've been lawyering it through the whole thing," said Hornstein. "I mean, really. The city approved these plans." GETTING MARRIED? "Right off the bat, it seemed she has this sweetness that was almost too good to be true," said Ron Gal-dieri, who filed the first complain with the Bronx district attorney last summer. "She was like a charmer." And Galdieri was charmed until he tried to cash in his investments. That's when Mrs. Penza's excuses grew stranger and she became more hostile. Mrs.

This was news to the building's developer and its architect, who knew nothing of the alleged noise pollution. "When somebody calls and says, "It's a pathetic situation from every perspective," he said.

"It's tragic when anyone loses money. It's equally tragic when a family is split asunder by something like this. She's near total physical collapse." Victor says Mrs. Penza has nowhere near the assets she is accused of pilfering, adding she and her husband live on Social Security in a heavily mortgaged condo. Galdieri's wife knew Mrs.

Mary Penza was a godsend to elderly church women at St. Mary's Catholic Church in the Bronx, suggesting investments, writing their wills and doing their taxes.

But the Palm Beach Gardens woman, thought by her clients to be a certified public accountant, is accused of bilking five women out of $700,000 in a case nicknamed "The Godmother Scam." "I considered her a friend and look what she did to me," said Mary McCarney, who at 77 is ill, home-bound and in need of nursing care. She met Mrs. Penza at church and turned over more than $3,000 for investments. "I don't want to talk about it."
