Defense lawyers in a Norfolk, case indirectly pose another question as well: if these disc jockeys are liable for prosecution under federal law, why does the Justice Department rarely act except in the case of a man who coin-cidentally was "broadcasting license numbers of unmarked police cars? Last month, John Frank Nesci, a disc jockey at WOWI-FM, a Norfolk rock station, was indicted by a federal grand jury for allegedly violating a law against "utter' (ing) any obscene, indecent or profane language by means of radio communication." Nesci's trial date has been set for Nov. 28, with his defense being prepared by the Stern Community Law Firm in Washington and the Virginia chapter of the American Civil Liberties Union. Summarizing the case, these lawyers said the indictment "was based on a June 8, 1972, broadcast by Mr.

Nesci during which he played a selection from the Woodstock album by Country. Joe and the Fish, a nationally-known rock group. "The selection, an nam War song, begins with an audience participation cheer in which the group shouts out, 'Give me an to which the audience shouts back, 'F'. "The same follows for the letters 'U', and 'K. A member of the group then shouts, several times, "What's that The audience responds with the completed word.

In the record, however, the audience's response is virtually the summary added. The dispute over whether the lyrics are obscene centers on whether in their context thye appeal to "prurient interests" and therefore are not protected by the First Amendment. The defense may argue that as a preface to an antiwar song the cheer has "socially redeeming importance" and that "strong words, even four-letter words, are protected speech."
