PAGELABELTAG B4 THE PALM BEACH POST REAL NEWS STARTS HERE I WEDNESDAY, JUNE 12, 2013 State: Goodman should remain on house arrest West Palm to new firms: Tell us if you may offend By Daphne Duret Palm Beach Post Staff Writer WEST PALM BEACH -Palm Beach County Circuit Judge Jeffrey Colbath properly used his judicial discretion by keeping Wellington polo mogul John Goodman on a $4 million bond and house arrest after throwing out his DUI manslaughter conviction, state prosecutors say. In paperwork filed Monday contesting Goodman's appeal of his appellate bond, Assistant Attorney General Richard Valuntas rejected claims Goodman's defense team made last month. Goodman's attorneys argued to the state's 4th District Court of Appeal that because their client won a new trial May 3 based on jury misconduct, Colbath should have restored Goodman's $100,000 bond and "no house arrest" provisions that were in place before his 2012 trial. The matter is now up to the West Palm Beach -based 4th DCA to decide. word he used to describe Goodman's defense at his first trial in March 2012.

In the response filed Monday, Valuntas summarized Goodman's defense that he suffered an injury in the crash that killed Wilson and drank liquor at a friend's "man cave" afterward to numb his pain, saying Goodman's "trial testimony exposed him as a liar." Valuntas said that because Colbath didn't know of Goodman's defense when he initially granted him the $100,000 bond before the first trial, he was warranted in now ordering the higher amount. Even with $4 million on the line, Valuntas claims Goodman has the means to flee the country, making house arrest necessary as well. "He could simply board a private boat or airplane, and flee to a country that does not have an extradition treaty with the United States," Valuntas wrote. dduretpbpost.com But on Monday, in a response to Goodman's motion, Valuntas said the appellate court should defer to Colbath's ruling. "The trial court's ruling was not arbitrary, fanciful or unreasonable so the trial court did not abuse its discretion by denying petitioner's motion to reduce bond," Valuntas wrote.

Valuntas said considering Goodman posted a $7 million cash bond while he was appealing his 2012 conviction and 16-year prison sentence in the death of 23-year-old Scott Patrick Wilson, the lower $4 million bond Colbath imposed ahead of Goodman's upcoming second trial was not beyond what he could afford. Goodman's brother and sister each put up half on his bond money last year. After Colbath reduced the amount, the Palm Beach County Clerk Comptroller's office is refunding the siblings $1.5 million each. Though Valuntas said Colbath's order wasn't "fanciful," that's just the Dusty, noisy or smelly companies to get a hard look. By Andrew Abramson Palm Beach Post Staff Writer WEST PALM BEACH -Dusty, noisy and smelly companies will need additional approval by the West Palm Beach City Commission before opening in the city's industrial areas.

The commission on Monday voted 4-1 to require all new businesses, and existing businesses looking to expand their current use, to fill out a form that will determine whether they generate dust, noise, smell or vibration on the adjoining property. If it's determined that the company could disturb residents, it will need special approval by the commission. This comes after numerous residents in the Northwood Hills neighborhood complained that Architectural Testing, a lation. "This is a very unique city," south end resident Alan Levine said. "Residences are near industrial centers.

You have to keep that in mind." Commissioner Shanon Materio said it was a minor change that would protect residents. "We're probably not going to address this for another 20 years and this is probably the most mild way of being able to address it with the least amount of resistance from the business community," she said. Commissioner Keith James, who cast the lone dissenting vote, said the city was changing its rules because of problems with one company. "These are industrial areas," James said. "These are not going to be your clean service industry type of businesses.

That's why we have the designation. I think this is overkill." aabramsonpbpost.com Twitter: abramsonpbp company running plane engines in an industrial area next to North-wood Hills, was disrupting their lives. Architectural Testing, which builds mock-ups of buildings and tests whether they can withstand hurricane-force winds, torrential downpours and other potential natural disasters, put up a large wall to muffle the noise. But the city wants to avoid future problems in industrial areas, despite a plea from several local business leaders asking the commission to vote against the proposal. "I don't think that's the correct way to approach the business community," said West Palm Beach commercial Realtor John Schmidt.

"Businesses are spending hundreds of thousands of dollars to open here in West Palm Beach, and it certainly sends a bad message if they trip over one of the rules and they're going to get punished."
