THE ARIZONA DAILY STAR TUCSON, SATURDAY, SEPTEMBER 27, 1980 Doctors ask state to drop malpractice aid PHOENIX (AP) Malpractice claims have "quieted," so physicians no longer need a state subsidy for up to $3 million in insurance coverage, the Arizona Medical Association said yesterday. The Joint Underwriting Plan, a subsidy established in 1976 to protect doctors against malpractice claims as private insurers pulled out of Arizona, was scheduled to terminate March 1, 1981. There was speculation that an extension would be requested by the medical association and the physician-owned Mutual Insurance Co. of Arizona. Mutual also was created in 1976 to provide the first $100,000 of malpractice coverage.

Word that the state subsidy no longer is needed was contained in a letter to all legislators, the medical association said in a press release. "They didn't tell me," said Sen. Robert Us- dane, R-Scottsdale, chairman of the Senate Health Committee. "In fact," he said, "I was at a meeting on the Joint Underwriting Plan about two weeks ago. There was a report that they labeled a draft.

I was so upset based on that report, I asked for a meeting with Michael Low," the state insurance commissioner. Usdane said he would meet with Low next week to discuss examples of malpractice judgments used in the draft report that he said showed Joint Underwriting Plan reserves may not be high enough. John T. Clymer, medical association president, said Mutual has grown strong enough to meet coverage needs without the subsidy. "The medical malpractice crisis of 1975-76 has quieted to some extent, and affordable coverage has been arranged by the Mutual Insurance Co.

of Arizona," Clymer added. "Several major insurance companies are also once again interested in providing professional liability coverage to Arizona's physicians," he said. Mutual "is financially strong and intends to compete with these major companies," he added. Usdane said he had heard of no insurance company other than Mutual being licensed to offer medical-malpractice coverage in Arizona. "I'd love to see some insurance companies come in," he said, "but I'm not aware of any." The Joint Underwriting Plan sets aside a reserve fund of taxpayer money with a potential of meeting up to $14 million in claims, Usdane said.

The reserve fund can be tapped to pay claims not covered by Mutual. 5 cottagemates escape Catalina Mountain School The Associated Press Five youths were serving terms on various offenses fled the Catalina Mountain School last night, the Ari zona Department of Correc tions said. The five, all residents of the same cottage, were last seen about 7 p.m. and discovered missing about a half-hour later, officials said. Tracks were found leading from the school, they said. The school, northwest of Tucson, was formerly called the Arizona Youth Center.

1 The five were identified as Daniel Porter, 16, serving a term for burglary from Pima County; Derrick Derello, 17, serving a term for burglary from Maricopa County; Bryant Long, 16, serving a term for burglary and assault from Mancopa County; John Elliott, 16, serving a term for stolen vehicles from Pima County and Steven March, 17, serv ing a term for aggravated assault on a police officer from Mohave County. A spokesman said 15 youths have fled the school since Jan. 1, compared to 76 sale. Most items in broken sizes, colors and styles. in the same period last been taken.
