Shipwrecked Youths Drift, Swim 3 Miles ATLANTIC CITY (UPD Two youths clung to the bobbing bow of their partially submerged motorboat for four hours last night while two companions swam three miles through a heavy surf to summon rescuers. William DiCioccio, 21, of Pine Hill, N.J., and Thomas Krajewski, 19, of Reynoldsburg, thought for a time they would not be found after an airplane and helicopter circled above them, dropped flares, and then went off to search another section of the Atlantic. DiCioccio finally managed to alert the helicopter crew to their position by diving underwater, ripping a waterproof, battery-powered light from the vessel and using it to flash an S-O-S signal. They were taken to Atlantic City Hospital for treatment after their rescue, but doctors said they came through their ordeal in good condition. Their companions, Walter Christiansen, 19, of Parkersburg, W.Va., and Rick Bowell, 21, of Cherry Hill, N.J., also recovered quickly from their three-mile swim to shore.

An advisory opinion written by Deputy Atty. Gen. B. Wilson Redfearn to Dr.

George E. Voegele, superintendent of the Gov. Bacon Health Center, states that Delaware law does not recognize "patient-physician privilege," or absolute privacy of communication. "A doctor's duty to keep a confidence may be outweighed by a higher duty to give out information if there is sufficiently important interest to protect," Redfearn said. HOWEVER, while the doctor may not be held ethically or criminally liable, a civil suit could be brought by a patient who felt himself damaged by revelation of confidential information.

Redfearn pointed out that "such damages may be difficult to prove." Dr. Voegele had asked the attorney general's office for an opinion on physicians' liability for revealing patients' communications. THE DELAWARE Code does provide that the Medical Council of Delaware may revoke or suspend the license of a physician who reveals a priviliged communication. A court order would provide an exception to this penalty. The opinion noted that a person may waive his right to have communication with a doctor kept confidential.

Redfearn suggested a form to be by the Health Center for obtaining such waivers from patients. In view of the requirements of medical ethics and the power of a court or a patient to authroize release of confidential communications, Redfearn advised Dr. Voegele not to release any such information without either a release from the patient or a court order.
