Abeldt was born Norma Jean McCosh on July 3,1922, in the Buckeye community She had helped her husband in the Abeldt Insurance Co. and Cornerstone Realty Her husband, Lowell, died July 9, 2001. Survivors include a daughter, Sandy Abeldt of Abilene; a son, Larry of Hope; and four grandsons. The funeral will be at 1:30 p.m. Friday at Abilene Brethren in Christ Church.

19,2001. Mrs. Chittenden was born Madena T. Hoagland on May 7, 1912. in Jetmore.

She worked at the Hays Daily News and Hays Travel Agency Her husband, Herbert, died in 1965. Survivors include three daughters, Jane Seeman of Vienna, Susan Wittwer of Colorado Springs, and Pamela Birchfield of Prairie Village; three sisters, Lavone l''i'ench of Tulsa, Juanita Weedman of Houston and Marchetta Rassmussen of Montrose, six grandchildren; and eight great-grandchildren. Mr. Grabbe was born May 11, 1920, at Antonino. He was retired from Baxter-Travenol Laboratories. He was preceded in death by his wife, Alfreda, in 1989; and a daughter. Sheila Grabbe.

Womack on Nov. 16, 1915, at Sylvia. She was a homemaker and worked at Stanleys Fashions. Her husband, Merwin, died in 1981. Survivors include two sons, Larry of Topeka and James of Highlands Ranch, and four grandchildren.

Hauschel was born Sept. 6, 1913, at Morrowville. He was manager of a service station. He was preceded in death by his wife, Bessie, in 1998; and a son, John in 1964. Survivors include a sister, Margie Leonard of Fairbury Neb.

Mr. Moss was born Juno 7, 1908. at Clinton. Neb. He was an automobile mechanic in Denver, retiring in 1973.

He was preceded in death by his wife. Hazel, in 1986; and a son, Robert "Bobby" in 1985. Survivors include three daughters, Maryella Hampton of Herington and Pearl Claussen and Roberta Piatt, both of Denver; a brother, George "Bud" of Alliance, eight grandchildren; 15 great-grandchildren; and a great-great-grandson. Steven Kent Rose NEW YORK Steven Kent Rose, 51, New York, formerly of Wichita and Winfield, died Tuesday Dec. 25, 2001. Mr Rose was born Aug. 31, 1950, at Liberal, Kan. He worked for Metropolitan Life in Wichita and New York.

Survivors include his father, the Rev. Dean Rose of lola, a brother, Fred of Lihue, Hawaii; and a sister, Sheryl Berg of lola. A memorial service will be at 11 a.m. Monday at Trinity United Methodist Church, lola. Private inurnment will be at a later date in Highland Cemetery lola.

Helen L. Stokes, 82, Cheyenne, died Friday Dec. 21, 2001. Mrs. Stokes was born Helen L.

Holmes on April 23, 1919, at Marysville, Kan. She worked for Safeway Bakery Her husband, Daniel died in 1975. Survivors include two sons, Milton H. of Salt Lake City and Bertun L. of Cheyenne; a daughter, Mary Margaret Holler of Loveland, six grandchildren; and eight grandchildren.

Sadie Upshaw Sadie Upshaw, 82, Salina, died Tuesday Dec. 25, 2001. Mrs. Upshaw was born Sadie on March 6, 1919, at Norwich. She was a homemaker She was pre- Sf'hi? 'hus'- MRS.UPSHAW band, Kermit in 1999; two sons, Ronald Keith in 1949 and Thomas Dean in 1996; and a daughter, Judy Ann Upshaw in 1941.

Survivors include three sons, Gary C. and John both of Pace, and Richard A. of Salina; four daughters, Jeanne Marie Diamicis of Bedias, Texas, Mary Ann Furgye of Hammond, Shirley Rae Harper of Wichita and Patricia Sue Duncan of Merced, two half brothers, Cecil Miller and Jess Miller; 21 grandchildren; and 19 great-grandchildren. The funeral will be at 2 p.m. Saturday at Roselawn Heights Memorial Chapel, 1920 E.

Friday Kenneth Lee Walker CAWKER CITY Kenneth Lee Walker, 75, Cawker City died Wednesday Dec. 26, 2001. Mr Walker was born June 11, 1926, at New Kensington, Pa. He was a construction worker. Survivors include his wife, Delores of the home; two stepsons, William Denardi of Redlands, and Jay Denardi of Cawker City; a stepdaughter, Sandy DeRito of Redlands; a half bi-other, Glenn Walker Jr.

of Wilson, N.Y; a sister, Betty Clark of Wilson; nine step- grandchildren; and nine step- great-grandchildren. There will be no service. The body was cremated. Memorials may be made to Kansas Veterans Home. There will be no visitation.

10,1962, at Salina. He was a financial adviser for Waddell and Reed, Lawrence. Survivors include his parents, Leslie E. and Mary Gay Wenger of Garfield, a sister, Diane G. Heinauer of Apache Junction, and his grandmother, Martha Dillingham of Salina.

He was an operating engineer in the construction industry His wife, Estelle, died in 1998. Survivors include two sons, Edward of Weston, and Jack of Santa Fe, N.M.; a daughter, Tootsie Bernat of Chicago; six grandchildren; and eight great-grandchildren. Matthew 2:1,2 (NIV) KANSAS SUPREME COUF Death penalty studied Justices have spent year deliberating on first death sentence By The Associated Press TOPEKA For more than a year, the Kansas Supreme Court has been deliberating on its first death penalty challenge since the state renewed capital punishment seven years ago. Given the legal complexity of the case and the life-and-death ramifications, prosecuting and defense attorneys say it's a good thing the seven justices are taking the longest deliberation in recent memory The court's ruling, which could come Friday will affect all Kansas capital murder cases. "There's no question the opinion could have a tremendous Impact on how these cases are tried in the future," defense lawyer Tom Bath said.

The court heard oral arguments Dec. 7, 2000, in the case of Gary Kleypas, the first man sentenced to death since 1994, Kleypas, one of four men on death row in Kansas, was convicted for the 1996 slaying of Carrie Williams, a student at Pittsburg State University In their appeal, Kleypas' attorneys raised more than 50 legal issues specifically about the case. But they also made more general challenges to the Kansas law's constitutionality. One challenge regards how the law weighs mitigating and aggravating factors attorneys use when arguing for or against a death sentence. Under the law, if aggravating factors raised by prosecutors outweigh mitigating factors brought by the defense, then juries are instructed to vote for a death sentence.

Conversely if mitigators outweigh aggravators, then the sentence is life in prison. But if the factors balance, the law still calls for the death sentence. Bath, one of just a handful of defense attorneys in Kansas qualified to try a capital case, said that provision is unique to the Kansas law. He and fellow defense auov- neys say that provision is unconstitutional because it shifts the burden of proof from the prosecution to the defense. One case that will be affected by the court's decision is that of John Robinson, who's charged with slaying three women each in Kansas and Missouri and leaving their bodies in barrels.
