(AP) A bill eliminating need for some private clubs to operate liquor pools will be introduced by a Senate committee for consideration this session, the panel agreed. The Senate Federal and State Affairs Committe also endorsed measures banning bottle rockets in Kansas and setting state safety standards for commercial boats. The bill to be introduced by the committee is sponsored by Sen. Ron Hein, R-Topeka.

It would change the laws on the books since 1965 requiring the state's Class private clubs to operate liquor pools. However, the bill includes a provision that for a club to be able to legally dispense liquor by the drink, it would have to Eliminate Liquor Pools for Some Private Clubs do at least half its business in food sales. Hein's original proposal did not include the food sales provision. Including the food sales provision is seen as improving the bill's chances of winning enough support for passage. Some senators who support a liquor-by-the-drink constitutional amendment think it should be tied to food sales, so only legitimate restaurants are permitted to sell mixed drinks.

The committee's bill also would permit private clubs to enter into reciprocal agreements under which they would honor each other's membership cards. However, it would not eliminate the 10-day waiting period for club membership or the $10 membership fee, as Hein proposed. The bill follows an opinion issued by Attorney General Robert T. Stephan which concluded a state Supreme Court's decision last November had defined an "open saloon" in such a way that private clubs do not need to operate liquor pools. The open saloon is prohibited by the state Constitution.

Stephan had warned in his opinion that the Legislature should exercise caution in how far it went and how fast in changing the private club laws. That admonition apparently led the committee to decide not to make wholesale changes in the law. Reciprocal agreements could be formed among individual restaurant-clubs or hotel and motel chains. The bill was not introduced Thursday, but is expected to be submitted Friday, then referred back to the committee for hearings and study. The committee endorsed for passage Thursday the bill making sale or possession of bottle rockets a Class misdemeanor, punishable by a $1,000 fine and, or, six months in jail.

Sen. Bill Morris, R-Wichita, was the main supporter of the measure, saying bottle rockets are the leading cause of fireworks-related fires in Kansas. The Federal and State Affairs Committee also approved a bill aimed at preventing tragedies similar to the June 17,1978, capsizing of the showboat Whippoprwill on Lake Pomona, in which 15 persons, including a pregnant woman, drowned. Hein said he submitted the bill in a slightly different form at the request of the Rev. Milton Vogel, a Topeka minister whose wife, daughter and granddaughter died in the Whippoorwill episode.

Vogel urged the. committee to pass some state regulations for commercial boat in Kansas "so that those 16 who died last June, three of my own family, will not have died in vain." Hein told the committee if the Whippoorwill had been up to current Coast Guard safety standards the night of the capsizing, there would be a good chance the boat would not have overturned when hit by what witnesses described as a small tornado. Mrs. Rideout not be reached for comment Thursday. The latest separation is the couple's fourth since their marriage Nov. 15,1976. It came as no surprise to Charles Burl, one of the two lawyers who represented Rideout at his trial.

"It's exactly what I expected," he said. "It fits the same pattern. They have separated and reconciled repeatedly, and it's a pretty tough history. "Their just youngsters with a lot of problems." Rideout said Thursday that his wife recently asked him to join her in seeing a marriage counselor. "I said, 'fine' but I never heard anything more about it," Rideout said.

When they reconciled, he said, "I tried to put everything in the past, and I felt I accom- plished it." In an interview last week with an Associated Press reporter, Mrs. Rideout said the couple had yet to visit a marriage counselor. "We should," she said, "things aren't peachy-keen around here." She did not elaborate except to say that when the subject of Rideout's trial comes up "we end up disagreeing and Rideout faces a domestic relations court hearing on April 16 on the state's attempt to gain $4,256 reimbursement for welfare funds received by his wife and child during the times the couple were separated. (AP) Three of the four black members of the Wichita Civil Rights and Equal Employment Opportunity Commission resigned Wednesday night, protesting the firing of the commission's black director.
