Now It seems clear enough that what Marshall was talking about were taxes specifically laid on some particular agency of the govern ment; thus, for example, a state tax on the salaries of the federal Judges might abolish the federal Judiciary In that state. But would he have held that an income tax laid on all incomes alike could destroy the federal Judiciary or Imperil Its inde pendence? Maryland was trying to lay a tax on the national bank that it was not laying on Maryland banks. It was this discrimination, it seems to me, that Is the essence of Marshall's objection. For that made the tax not a revenue measure but a device for penalizing the national bank. And it was with this in mind that Marshall uttered the famous dictum that "the power to tax involves the power to destroy." A tax which is not directed against any particular security or salary but falls equally on all incomes of the same size does not, it seems to me, have any of the characteristics of the tax that Marshall was considering.

Tills, I take it, was the view of Mr. Justice Holmes in 1920 when, discussing an income tax on judges' sal aries, he said in the dissenting opinion in Evans v. Gore that "to require a man to pay the taxes that all other men have to pay cannot possibly be made an instrument to attack his independence as a judge." She didn't throw the glasses away. They were too good. The Rocks Again JAMES J. WALKER, local man about town, has hit on a swell idea. Somewhere, he managed to get a photograph of The Rocks (you know 1638 landing place of Swedes) and has had it enlarged.

The scene shows the rugged Brandywine granite natural wharf and a sailing ship moored to the rocky ledge. With this photo he includes a view of Old Swedes Church as it was some 50 years ago. And the town's windows are ablaze with displays of the pictures. No Professor Here can them just Evelyn and i Edward, recently married. They are snug in their new home and axe keeping house rather well, except for their cursed absent-mindedness.

So, when Evelyn and Edward invite you to dinner, you had better make plans for eating elsewhere. You never can tell Evelyn and Edward might not be home. The tree was at Hollywood and belonged to the Warner Brothers Studio. Recently it was destroyed by wind and it required 92 sticks of dynamite to remove the reenains. Irene Stiles of Wilmington, and Mrs. Hazel Fredlund of Pasadena, Calif also three great grandchildren. Maurice Martin of Wilmington and Jack and Dick Fredlund of Pasa dena. The interment of Mrs. Stiles was in Mount Forrest Lawn Park, with services in The Wee Kirk O' the Heather, Forrest Lawn Memorial Park, in Glendale.

Letters To The Editor Mr. Howie First to Use New Grading System TO THE EDITOR: I wish to make correction in connection with the article on page 10 of the Journal-Every Evening on Monday, April 25. In the article with reference to the Delaware High School Conference held at Newark on Saturday last, I am quoted as declaring that a stand-arized marking system is needed. It seems rather farcical that the superintendent of the first district in the state to use new type report cards for both elementary and high school, which eliminate all attempts at standardized marking, would advocate a standardized marking system for the state.

One of my statements at the conference was to the effect that it was impassible to standardize anything as subjective as grades. I know tfcat the facts mentioned in your article were placed there in good faith and were a result of misunderstanding, but I do feel that I could not leave it unchallenged, as my philosophy with reference to this situation is that growth in all phases or the child activities and life is the real aim of education and that marks and grades have played too prominent a part in our educational program. The working for grades and credits has brought about too many people with inferiority and superiority complexes. Our system of evaluation does not base the child's success in school on a com petitive basis but rather upon his own activities and aptitudes. May I thank you for printing this correction? Ella Stiles now deceased, with the exception of two years, 1920 and 1921. Mrs. Stiles passed away on Dec. 19 last, and was the widow of the late Wallace G. Stiles, also formerly of your city.

Mr. and Mrs. Stiles came to Wil mington during the year 1877. and Mrs. Stiles since February, 1921.
