(AP) A Lincoln County father tai fited a suit in the state Court of Claims afar hte son was injured while taking part in phyiical education clasaea at Harts High School. Andrew Raket fifed the suit on behalf of hta U-yairoU ton, Timothy, who was injured April 29,1975, while takfeuj part in wrestling exercises. The suit names the Lincoln County Board of Education and the nhyskal education instructor, Benjamin flatten.

Rakes alleges his son was told to wrestle another youth who was three years older and weighed 25 pounds more than his son. He said his son sustained severe and permanent injuries, including a fractured right leg. CLARKSBURG, W.Va. (AP) Jury selection began Monday in the trial of Calvin Adkins, 37, charged with first degree murder in connection with the fatal shooting of Joseph Shaffer, brother of Clarksburg Mayor James Shaffer. Shaffer, 38, president of American Vending was shot five times the night of Nov.

3 on a city street, police said. John Wolfe, 31, brother-in-law of Joseph Shaffer, was wounded but since has recovered. In addition to Adkins, two other men face charges in the case and are scheduled for trial later. Charles Moran, 47, was charged with aiding and abetting the killing of Shaffer and malicious wounding in Wolfe's shooting. Gaines was charged with attempted murder.

State Court To Rule On Coal Case CHARLESTON, W. Va. (AP) The state Supreme Court will hold a hearing May 3 on a petition asking it to prohibit Judge James G. McClure of Wheeling from" conducting further proceedings as special judge in prolonged coal property litigation in Marion County. The high court acted by 3-0 Monday in granting the hearing.

Justices Richard Neely and Thomas B. Miller were absent. The court acted on a petition presented last week by former Supreme Court Justice James M. Sprouse. The case is one in which Sprouse, as counsel for the parties petitioning the supreme court, alledged that Judge Harper Meredith qf Marion County Circuit Court presided more than four years in the stillpendmg litigation without disclosing a conflict of interest.

Sprouse appeared as counsel for Stern Brothers Harold W. Wilson as trustee, and the Stern-controlled Wood County Bank of Parkersburg. They are defendants in three suits brought by Consolidation Coal Co. in Marion County Circuit at Fairmont. Consolidation sued to bring about partition--that is, division among the joint owners--of 12,000 acres of coal property.

Stem Brothers, according to the petition in the supreme court, owns an undivided interest in the property which, if divided, would amount to about 4,000 acres. The rest is either owned by Consol or controlled by it through lease. The Wood County Bank holds a lien on the Stern Brothers interest in the property. Meredith disqualified himself last July from presiding further in the case after the defendants alleged he had shown bias in favor of Consol and had failed to disclose joint interests he held with Consol in coal property. Sprouse made no allegations against McClure, judge of the 1st Judicial Circuit in the Northern Panhandle, but maintained be was improperly named special judge in the Marion case.

MARTINSBURG, W.Va. (AP) West Virginia and Virginia police and federal agents have seized an estimated $250,000 in drugs from what they described as "a clandestine drug manufacturing laboratory" on a farm near here. Four men were arrested during the raid and charged with the manufacture and possession with intent to deliver of a controlled substance. They Were identified as Dorsie Church, 33, Hemdpn, and Las Vegas, Dabid Detamore, 10, Salisbury, Stanley Spurlock, 37, Ashburn, and Randall Crane, 19, Falls Church, Va." Authorities said the men were arrested on a farm that spead over some 60 acres of Frederick County, and 87 acres in Berkeley County, W.Va. Seized during the raid were large amounts of phencyclidine (PCP), a animal tranquUizer that is commonly known as "angel's dust." Wheeling Civic Center To Open WHEELING, W.Va.

(AP) The 99 million Wheeling Civic Center will open here Tuesday, April 19 with an appearance by the Doobie Brothers, a rock musk band. The civic center, located between 14th and 15th streets in downtown Wheeling at the site of the old BO Railroad station, will seat an estimated 6,500 fans for indoor sporting events. Larger crowds can be accomodated for such events as concerts and exhibits. Olivia Newton-John will be the center's second attraction, on April 24, with an ice and circus also booked in the near future. Petersburg High Wins Drama Festival MORGANTOWN, W.Va.

(AP) Petenburg High School won tint place for its production of "Shubert'i Laat Serenade" in the 26th annual state high school drama festival held here Saturday. Morgantown High took second place, while Hedgesville was third. Marika Handakas of Hedgesville was named best actress, while Jon Frame of Morgantown was voted best actor. Turnpike Wreck Kills 1 MARMET, W.Va. (AP) A firey crash on the Wat Virginia Turnpike near here left one man dead and five persons injured in a three vehicle accident Monday, state police reported.

Authorities said apparently two tractor trailers collided at the Marmet bridge over U.S. 119. One tractor trailer, a tanker carrying a load of deisel fuel, ran off the turnpike and onto a section of U.S. 119 and the tank portion of the vehicle burst into flames. The other truck remained on the turnpike.

A member of the Marmet Volunteer Fire Department said one tractor trailer driver, Paul Walters, 37. of Wytheville, jumped from his rig moments before the cab of the vehicle burst into flames. He escaped serious injury. Another vehicle involved in the crash was carrying four members of a Clay County family. They were identified as Lyle Shreves, 41; his wife, Sylvia, 37; son, Jeffrey, 7, and daughter Elizabeth, 6.

Mrs. Shreves was listed in guarded condition and Jeffrey was listed in serious condition. The others were in satisfactory condition. State polic said the tractor trailer rig in which the man was killed was destroyed and that they were having difficulty determining the owner of the vehicle and the driver's name. They said they were attempting to find some mark on the vehicle to help in the identification process.

Traffic on U.S. 119 was blocked for nearly two hours while firemen battled the blazing vehicles. Turnpike traffic was blocked for about the same period. One lane traffic was still in effect late Monday. State police said they were attempting to determine the exact sequence of the accident.
