The "taxpayers' suit" was filed on January 30 in advance of the city's suit, and thus the city's action does not act as a bar against Stokes' clients, he said. The city cancelled all of its suits against TEPCO last week when the company paid the city $350,000 in Settlement of its street repair claims. GRANT SAID INVALID Stokes' amended bill claims that the City Council attempted to give the Nashville Coach Company, TEPCO's successor, a franchise by adoption of a resolution, a grant which it contends could be legally only by passage of an ordinance. The amended bill contends that the company sought to secure for itself a perpetual franchise by the method which the City Council used in approving the changeover to busses.
