Jones, founder of longshoremen's local Associated Press WEST CHESTER, Pa. A judge on Thursday struck down a drunken driving case after several state and local police officials ignored warnings that arbitrary roadblocks might violate state law. Judge Charles B.

Smith of Common Pleas Court thus declared certain roadblocks illegal and ordered charges dropped in a case involving a man who was stopped by state police in July. District Attorney James McElree said on Friday that he prosecuted the case despite his own reservations about the legal grounds. He said he had "suggested" to police in the county last year that they forego roadblocks in their campaigns against drunken drivers because state law requires an arresting officer to have "reasonable suspicion or probable cause" before stopping a suspect. However, three police departments, including th state police men's union, Mr. Jones believed in and practiced civil rights in his hiring policy during a time when such ideas were unpopular especially during the Depression years, when everyone was competing for a job.

"He was justly proud of dealing fairly with his fellow men," said a family member. Through the years, Mr. Jones often told his family stories highlighting his years in the local union presidency. One such story involved the local's working for a flat rate on a gunpowder product during World Warll. Mr.

Jones learned that a Philadelphia company was doing the same work and getting additional compensation for working with a dangerous substance. He demanded arbitration with the Du Pont Co. to review the pay differences. The Du Pont representatives had argued that their product was not dangerous, Mr. Jones told his family.

So he proceeded to take from his pocket a match and a small sample of the gunpowder. Before he could light the match, he said, the company officials agreed to grant extra compensation to his union members. Mr. Jones' wife, Hedwig died in 1976. He is survived by two daughters, Doris Wilson, with whom he had lived, and Patricia Marshall of Manette Heights; a sister, Frances Conway of Long Island, N.Y.; and a grandson.

Mass of Christian Burial will be offered Monday at 11 a.m. at St. Elizabeth's Catholic Church, 809 S. Broom with entombment in St. Hedwig's Crypt in Cathedral Cemetery.

Jones, co-founder and former president of the Wilmington local of the International Longshoreman's Association, died of kidney failure and pneumonia Thursday in the Memorial Division. Mr.

Jones, 83, lived at his daughter's home at 1517 Forsythia The Timbers, and was formerly of 406 S. Franklin St. He came to the Wilmington area from Liverpool, England, in the early 1920s, after serving in the British Navy. He later worked for a short time in the coal mines of Pennsylvania and then returned to Wilmington. In 1924 Mr.

Jones co-founded Longshoreman's Local 1223, now Local 1694, at the Wilmington Marine Terminal. He served as president of the union until World War II interrupted trade at the port. On Dec. 19, 1941, speaking for the union, he declared that all strikes by longshoremen would be barred because of the war effort whether due to wages or unfair working conditions. If necessary, "as in World War a stevedore regiment will be formed" to work with the Department of War in moving war materials, he said.

During the war, he worked at the Pusey and Jones Corp. and Harlan Corp. shipbuilding companies. After the war, he worked in the maintenance department at the Du Pont Co. Experimental Station for 15 years, before retiring in 1965.

A Brandywine Hundred woman was stabbed Thursday night during an argument at the Bellefonte Laundromat in the 800 block of Brandywine New Castle County police said. Ruth Reed, 39, of the 900 block of Brandywine was in fair condition Friday night at the Delaware Division, where she is being treated for a stab wound in her abdomen and a cut across her right hand, police said. Police arrested Jean Lutz, 45, of the 400 block of Shipley Wilmington, and charged her with first-degree assault and possession of a deadly weapon during commission of a felony. She was arraigned on the charges at Magistrate Court 11 in New Castle and released under $6,000 bond, police said. Police said the two women had been arguing in the laundromat about 7:20 p.m.

when Lutz pulled out a knife and stabbed Reed. Investigators said the confrontation stemmed from a prior conflict between the women, but the specifics were not disclosed. Gasoline leak at station closes lanes on U.S. 202 Gasoline leaking from an underground tank at a service station on Concord Pike (U.S. 202) in Talleyville forced the closing of both southbound lanes of the highway for more than eight hours Thursday night and early Friday morning, but no fire or injury was reported.

More than 200 gallons of the explosive fuel flowed onto the road "in rivers" according to a witness, after a pipe burst beneath a service island at the Talleyville Sunoco Service Center about 9:50 p.m. Thursday. Police and fire officials said the highway's southbound lanes were restricted until about 6 a.m. Friday, and the spillage had been cleaned up in time for the morning rush-hour traffic. A private spill-recovery firm spread two dump truck loads of sand on a 200-foot stretch of the 3000 block of Concord Pike across from Arby's Roast Beef restaurant to soak up the fuel.

Attendants at the station checking tank levels noticed "a considerable amount" of gasoline was missing, according to Bill Preston, chief of the Talleyville Fire Company, and then noticed the fuel bubbling up from cracks in the station EarlT.Collas HAVERTOWN, Pa. Earl T. Collas, 61, of 1225 Center Road, formerly of Wilmington, died of a blood clot Wednesday in the Veterans Administration Hospital, Del. Mr. Collas retired on disability in 1974 as a self-employed builder.

He had run Earl T. Collas Builders in Havertown for 25 years. He was a Wilmington native and had attended Alexis I. du Pont High School in Greenville. He entered the Army during World War II, serving in the Pacific.

In 1945, he married the former Julia Migliori and settled in Havertown. He was a member of the American Legion Manoa Post 667 and the Republican committee of Havertown. He was one of the originators of the Havertown Town Watch program. In addition to his wife, he is survived by three sons, Earl T. Jr.

of Downingtown, Patrick H. of Havertown and Ronald W. of Upper Darby; his mother, Helen Collas of Wilmington; three brothers, Leonard, William and Raymond, all of Wilmington; and nine grandchildren. A Mass of Christian Burial will be offered Monday at 10 a.m. at St.

Rose DeToro Rose DeToro, 83, of 1 Delaware Tuxedo Park, died Thursday of heart failure in the Emily Bissell Hospital, Newport-Gap Pike, where she had lived for the past month. Mrs. DeToro's husband, Antonio, a gardener on the Winterthur Estates for 50 years, died in 1971. She is survived by three sons, Nicholas of Faulkland Heights, V. James, with whom she had lived, and Raymond of New Castle; two daughters, Mary Cwirko of Long Island, N.Y., and Evelyn DaBunda of Toughkenamon, 11 grandchildren and 14 great-grandchildren.

Michael J. Wise, 30, of 236 E. Third died Thursday of respiratory failure in Crozer-Chester Medical Center, Upland. He had been hospitalized for the past week. Mr.

Wise, born in Chester, was a mechanical engineer for Sun Transport Co. in Aston Township for the past 10 years. He was a member of St. Luke's Christian Community Church. He graduated from high school in Chesapeake, and attended the Seaman's Church Institute of New York and New Jersey, where he received his engineering license.

He also attended Hartford Community College in Bel Air, Md. He is survived by his mother, the former Elizabeth Jones, with whom he had lived; his sister, Shir-lene Wise of Chester; and two brothers, Linwood of Chester and Calvin of Cecilton, Md. Services will be Sunday at 8 p.m. at St. Lukes Christian Community Church, Fourth and Central avenues, Chester, where friends may call at 6 p.m.

Burial will be Monday at 10 a.m. in Greenlawn Cemetery, Chester Township. Ethel M. Reese BALTIMORE Ethel M. Reese, 75, of the Church Home Hospital, 100 N.

Bond formerly of Wilmington, died of natural causes Monday at the hospital. Mrs. Reese was a retired chairman of the mathematics department at Roland Park Country School in Baltimore. She had been with the school approximately 12 years. During World War II, she worked for the former Hercules Powder Co.

in Wilmington as a biochemist. She was a graduate of the University of Delaware and received a master's degree in biochemistry from Duke University in Durham, N.C. Born in Warwick, Md. She moved to Wilmington at an early age and moved to Baltimore around 1930. Her husband, Dr.

Frederic died in 1963. She is survived by a son, Frederic M. Jr. of New Fairfield, a daughter, Elizabeth M. Reese of New York; a sister, Mrs.

William B. Green of Wilmington; and two grandchildren. A memorial service was held Tuesday at St, David's Episcopal Church, Baltimore. residents arrested in J. in cocaine find CARNEYS POINT, N.J. Two Jacksonville, residents were arrested Thursday on U.S. 40 after police found a half pound of cocaine hidden in the car. state police said.

Police said Robert Johnson, 47, and Dcnise Wilson, 24, were charged with possession of cocaine and possession with intent to deliver the drug. They were committed to the Salem County Jail for lack of $15,000 bond each, police said. Troopers stopped the car in which Johnson and Wilson were riding about 3:45 p.m. Thursday for a minor traffic violation and became, suspicious when Wilson tried to hide; her purse. Police said they found less than an ounce of marijuana in, Wilson's purse and arrested the pair.

They said $7,000 in cash also, was found in the purse. The shooting had endangered others and there had to be some period of incarceration, the judge said. Clarence Aden "Dick" Cover, founder of the Cover-Rossiter accounting firm, died of cardiac arrest Thursday in the Delaware Division. Mr. Cover, 79, of Foulk Manor North at 1212 Foulk Road, formerly of Greenville, founded Cover-Rossiter in the 1940s. He retired from the firm on Foulk Road in 1979.

He was only the 35th accountant to earn a CPA certificate from the state of Delaware when he received his in 1940. Mr. Cover was a past member of the board of trustees of Wilmington Savings Fund Society, past treasurer of the Episcopal Church Home Foundation and a member of Christ Church Christiana Hundred, where he served on the vestry.

He was a member of the Delaware Optimists and past chairman of the membership committee of Delaware Certified Public Accountants. He was a member of the Wilmington Country Club. The defendant, Elwood H. "Woody" Harper, 38, of the unit block of Darlington Road, Harmony Hills, was sentenced by Judge Joshua W.

Martin III of Superior Court to consecutive terms of two years in jail on each of three charges of first-degree reckless endangering. Martin suspended the last two years for probation. Harper pleaded guilty to the charges on Nov. 23. He initially was charged with attempted first-degree murder by firing several shots from a rifle out of a window at Deville Court Apartments, off the Kirkwood Highway, where he then lived.

The incident occurred on Sept. 3, and Howard Hillis, Harper's attorney, said that Harper was under emotional pressure at the time because he and his girlfriend had been harassed over a period of time.
