WTGI-TV (61) probably will be seen in some Heritage Cablevision homes as early as next month, thanks to the Federal Communication Commission's latest "must- carry" rule. "It seemed to our attorneys and to management that we do have an obligation to carry Channel 61," said John Calvetti, Heritage's general manager. The move might result in a Igreater variety of programming on 61, including local public shows. WTGI became essentially a 'home-shopping station last fall the station's syndicated series and movies proved too expensive to continue.

The station later filed for protection under Chapter 11 of the U.S. Bankruptcy Code. The financial trouble arose 'partly because Heritage refused to 'include Channel 61. Heritage projected low viewership for Channel ,61. In addition, it operates its own local channel (WNS-TV, Channel 2), which competes with WTGI for 'advertisers.

The FCC did not compel Rollins Cablevision (which later sold out to 4:00 4:30 5:00 On the tube by Heritage) to add WTGI when it went on the air, since the company already carried enough local stations. Nor was Heritage required to carry the station after the current FCC ruling went into effect. Although the FCC increased obligations of cable companies to carry local stations, Heritage was exempt from additional obligation because it operated too few channels. But Heritage recently began rebuilding its system, increasing the number of channels. It became obligated to carry WTGI in rebuilt areas and will when it has installed the necessary equipment.

Eventually the whole county will be rebuilt and will receive WTGI. "This is what we've needed from the beginning," said Dan Slape, Channel 61 general manager. "It's unfortunate we had to have an FCC ruling to get carried in our own back yard." Slape said negotiations with Heritage on the matter have been smoother than with Rollins. "We don't get stonewalled anymore." The Storer Cable System in Kent County and Signet Cable in southern New Jersey also will carry Channel 61 under the FCC rule. Under consideration to join the home-shopping shows are an exercise show, a business talk show, prime-time movies and sports programs. Slape said he would like to resume local news breaks and "expand the concept of 'Focus the local talk and informa--tion show now on the station. Also considered is a joint news venture between Channel 61 and Heritage, which already presents a newscast on its Channel 2.

Slape noted that WTGI has a contract with Consumer Discount Network into February and "we would need some relief in that area" to reduce the amount of home shopping before then. Also, "We have to be able to assure ourselves that it will pay." Heritage's Calvetti said he hopes Channel 61 will expand successfully, especially since the system already carries two full-time shopping stations. Slape hopes for success because it would move the station closer to what it was conceived to be before it went on the air and because he thinks it would result in additional viewers, who might be needed if Channel 61 is to stay on Heritage. The FCC requires local stations to draw 2 percent of the viewers in its market before cable systems must carry them. WTGI has been exempt because new stations get time to settle in, but it must show it has the 2 percent by June.

Since several cable companies are challenging the FCC ruling in court, it is possible the must-carry rule will change again and let Heritage off the hook. But, said Calvetti, "we don't like to put things on and then take them off."
