A small radio station found itself caught between federal law and a judge's ire Friday. The problem centered on a fiveminute, ad Lewis submitted du to by Smith, an heir to the Du Pont fortune and an independent candidate for the seat held by U.S. Rep. Richard Schulze, R-Pa. Smith was found mentally incompetent after he gave money to political extremist Lyndon LaRouche in 1985.

He continues to fight the ruling, and last week the Chester County Common Pleas judge in the case, Lawrence E. Wood, withdrew after enduring repeated attacks by Smith. In the ad, Smith responds to the judge's withdrawal. WCHE aired the ad twice Friday, then canceled the third airing after the judge's attorney threatened legal Associated Press action, station vice president and general manager. Mark Crouch said.

Crouch said he was discussing the situation with the American Civil Liberties Union because federal regulations prohibit censorship of political ads. Smith said he would complain to the Federal Communications Commission if the ad doesn't air Monday, Crouch said. "We pulled it, because couldn't commit myself to a lawsuit," said Crouch, whose station has three full-time employees and three part-timers. "I'm not sure I want to commit myself to have my license revoked either, but I want to think about it." Crouch said he offered Wood free rebuttal to Smith's ad, but the judge refused. "Our position is we don't like the commercials," said A.

Thomas Parke, Wood's attorney. "We believe they're defamatory." New incinerator to extend landfill WILMINGTON Trying to coax more life out of its landfill in New Castle County, the Delaware Solid Waste Authority plans to construct a second, $90 million trash-to-steam incinerator at the Pigeon Point disposal site. Steam from the authority's existing 600-ton-per-day incinerator is used to generate power to run the recycling and disposal operation. Excess stream is sold to the Atlas Point chemical plant of ICI Americas Inc. A small amount of power not consumed by the authority is sold to a regional network of power companies.

Although the entire 13,000 watt capacity of the new plant would be sold to the utilities, the new 600- to 800-ton incinerator would not pay for itself, said authority WOMAN RAPED: HARES CORNER A 27-year-old Wilmington woman was raped Thursday night by a man who offered her a ride, state police said. The man offered the woman a ride about 10 p.m., then drove to an unidentified location and sexually assaulted her, said spokesman Sgt. David J. Citro. He then dropped her off near U.S.

13 and State Road. Detectives at Troop 2 are investigating. By MERRITT WALLICK Staff reporter ARSON ARRESTS EXPECTED: WILMINGTON Investigators with the city's Arson Task Force continued to question suspects and check leads Friday in the fire that destroyed a former tire warehouse and Goodwill store Wednesday night. The fire at the adjacent buildings on West Fourth Street, between Jackson and Van Buren streets, was deliberately set, investigators ruled Thursday. On Friday, city Fire Inspector Daniel R.

Walton said arrests are expected early next week. Neighbors have said children and teen-agers frequented the va- manager N.C. Vasuki. "If the county continues to grow and the commercial activity continues to grow, we'll have to look for an alternative landfill site in the future. If we can postpone looking for another landfill site, it's worth it," he said.

The capacity to burn hundreds of tons of additional trash a day could double the remaining life of the landfill, according to Vasuki. The authority estimates the Cherry Island Landfill now serving New Castle County will be filled in about 17 years. The board of directors of the authority, which has approved development of the plan, must still give final approval for moving ahead with the project. Vasuki said bids for the project could be accepted late this year, with construction expected to take four years. POLICE cant buildings, often climbing onto the roofs.

MAN SHOOTS SELF: WILMINGTON A 79-year-old man accidentally shot himself Thursday, city police said. Estebor Maldoraldo, of the 200 block of N. Harrison told police a handgun he had in his home went off and struck him in his left hand. about 10:30 p.m., said Sgt. Martin P.
