If a careless workman will in spite of warning try to find out how many teeth the buzz saw has and the saw tires to find out how many fingers the man has, blame the workman--not the saw. If a sick man knows that hie neighbor has been cured of some trouble that prostrates himself and he carelessly neglects to use it, blame the man--not the medicine.

Let us see how well this statement wil! bear the scribe out in such a declaration. The fiist vote contained nine ballots, ot which Morris Crandall received one, Eli Woochvorth one, Albert Amidoii one and W. B. Jenkins sis and they had no right to resort to a second ballot as their action was a nullity and tho peisoa receiving a majority of the votes cast was duly eleoted. Tnc) have no power to declare vacant the office, or call another school district meeting for that purpose, The second ballot that was ordered which was entiiely illegal, resulted in selecting C.

Vv. Vickers who has since gave up the idea of holding the office so illegally obtained. Hence the scribe's mistake. 1 herewith enclose for publication the State Superintendent's letter replying to a communication 1 sent him days subsequent to the District School meeting which for the benefit of tho yet still ignorant I would like it published in over the signature of the State Superintendent, which settles the matter. Yours respectfully, W.

B. Jenkins. Albany, Aug. 1S97. W.

B. Jenkins, Purdy Cieek, Steuben Dear to your letter of August "th, 1 would say, that the consolidated law provides that the person leceiving a ruajoiity of all the ballots cast at an annual or special school district meeting shall be declared elected to tho office for which he is a candidate. Therefore if at your school district meeting nine ballpts wore jast, of which Mr. Jenkins received six, he received a majority of all of the votes cast for that office, and was duly elected. Having succeeded IB making a choice their power was exhausted, and they had no right to take another ballot for that office.

If they attempted to do so their action is aaullity and the person receiving a majority of the votes cast was duly elected. They have no power to declare vacant the ollice, or call another school district meeting for that purpose. Very yours, Charles K. Skinner, State Superintendent.
