WEDNESDAY, DECEMBER 18, 1996 LOS ANGELES TIMES MARCOS: Court Upholds Damages Against Estate Continued from A3 James P. Linn, the Oklahoma City lawyer who has represented Marcos' wife, Imelda, and her children for several years, acknowledged that his clients had substantial holdings in the Philippines, although he said he did not know their total worth. He said he thought it was unlikely that the Swiss banks would ever agree to turn over any funds to Swift's clients. He noted that the Philippine government has laid claims to those funds, as has a Los Angeles lawyer who recently won a $22-billion judgment against the Marcos estate in Hawaii. Linn said that the human rights plaintiffs will have to "come out of the stratosphere" and agree to some sort of compromise if they are to secure any meaningful recovery.

"Mrs. Marcos doesn't have $1.9 billion." He said Mrs. Marcos has agreed to settle the case by paying each of the 9,541 Filipinos determined to have a valid claim "several times their annual income." The current annual per capita income there is $1,085. Although it is unlikely that the full $1.9 billion will ever be obtained, Tuesday's decision set an important precedent, according to international law experts. "To use the term 'command responsibility' sounds novel," said UC Davis law professor Diane Amman.

"But it reflects a trend enunciate theories by which can be held liable for the nates." She said the ruling might pending in New York federal Bosnian Serb leader Radovan other men. "This is very unusual." Spielberg could not be reached for comment. A spokesman said the director was preparing to leave for the Hawaiian island of Kauai to finish shooting the sequel to his blockbuster film "Jurassic Park." A statement released by the academy said Spielberg bought the Oscar- -which Gable won for his leading role as a wisecracking newspaper reporter in 1934's best picture, "It Happened One Night" -to protect it from exploitation.

"I of no better sanctuary for Gable's only Oscar than the Motion Picture Academy," Spielberg said in the statement. "The Oscar statuette is the most personal recognition of good work our industry can ever bestow, and it strikes me as a sad sign of our times that this icon could be confused with a commercial treasure." Davis said the Gable statuette is important because it is one of a small and shrinking pool of vintage Oscars. Many of the awards handed out in the early years of the film business have been siphoned off to private collections or simply lost by families of the onetime stars. Gable's statuette, Davis said, is particularly significant because it belonged to a star whose very name has remained synonymous with Hollywood's heyday. Spielberg kept his gift a secret from virtually everyone.

He didn't even tell his mother. She learned about the donation when a Times reporter called her Pico Boulevard: restaurant seeking a comment and could contain her glee, she was so proud of her son. "That rotten kid," said Leah Adler. "I better call him." Spielberg bought the Oscar by phone on Sunday during Christie's daylong auction of movie memorabilia at the Pacific Design Center in West Hollywood. Several of Gable's personal effects were offered by his estate, including a set of golf clubs, a passport, a leather backgammon set and a collection of poker chips.

The Oscar's $607,500 price tag--which included the $550,000 price of the item itself, plus commission and tax- set a Christie's auction record. It surpassed the $563,500 a buyer spent three years ago to purchase an Oscar that Vivien Leigh won for her role in the 1939 best picture, "Gone With the Wind," according to a Christie's spokeswoman. Spielberg also spent $244,500 on a leather- bound copy of the script of the movie, which Gable once owned. On Sunday night, a Spielberg associate contacted the academy to offer the Gable Oscar. Shortly after, Davis of the academy spoke to Spielberg by phone.

"He simply said that he felt that this tribute to one of 1935 file photo shows Clark Gable with Oscar that was auctioned to Steven Spielberg for $607,500. the great figures in film history shouldn't end up as a tchotchke in a theme restaurant," Davis said. "We thought what he had done was terrific, and that we should give him credit. We sort of talked him into allowing us to mention who the buyer was." Excited academy executives announced the donation at a news conference Tuesday morning in front of their Wilshire Boulevard headquarters in Beverly Hills. "The man has a hell of a way with a holiday gift," said academy President Arthur Hiller.

The Gable Oscar is showing the signs of age: Most of the gold that once covered the eight- -pound award has worn off, showing the bronze statuette beneath. The marble base is chipped. The academy sought a temporary restraining order to keep the Oscar from being auctioned but a judge ruled last Friday that the academy did not give proper notice of the hearing to Christie's and did not notify Gable's son, John. The academy said Gable signed an agreement in 1957 giving it first right to buy the statuette if it was ever sold. Gable's Oscar is being stored in a vault at the academy headquarters.

In a few months, it will be placed on permanent exhibit at the academy's Center for Motion Picture Study on La Cienega Boulevard. On Thursday in Sharon, of leukemia. Harry Kemelman; Author of Rabbi Small Mystery Series Harry Kemelman, 88, author of a series of mystery novels featuring the heroic Rabbi Small. A high school and then a college English teacher, Kemelman gained a wide following with his series of a dozen books. The mysteries were translated into 17 languages and formed the basis for a 1977 television series titled "'Lanigan's Rabbi." He built titles around days of the week, beginning in 1964 with "Friday the Rabbi Slept Late." Kemelman quickly followed with "Saturday the Rabbi Went Hungry" and "Sunday the Rabbi Stayed Home." A native of Boston, Kemelman studied English and linguistics at Boston University and Harvard. He taught at Boston State College and Northeastern University, and began writing fictional detective stories for Ellery Queen's Mystery Magazine.

Next came the Rabbi Small books set in Barnard's Crossing, a fictional town not unlike Marblehead, where the author lived for 45 years. On Sunday in Marblehead of renal failure. Edward K. Milkis; TV and Film Producer Worked on 'Star Trek' Edward K. "Eddie" Milkis, 65, television and film producer who worked extensively on the original "Star Trek" series.

A native of Los Angeles, he began his career in the film shipping department at ABC. Next he served as a film editor on such successful movies as "North by Northwest" and "The Time Machine." He signed on as associate producer of "Star Trek" four weeks before it went on the air, and stayed three years. He eventually became post -production supervisor at Paramount Television, and then formed a production team with Tom Miller. Milkis' credits include the highly popular television series "Happy Days," "Laverne Shirley" and "Bosom Buddies." Among his feature films was "The Best Little. Whorehouse in Texas." Milkis last year was president of the Guardians of the Jewish Home for the Aging and he was active in the Stop Cancer charitable group.

On Saturday in Los Angeles after a lengthy illness. Willard Parker; Stage, Film Actor Was in 'Texas Rangers' Series Willard Parker, 84, an actor popular in second leading roles in theater, motion pictures and television. Parker is probably best remembered as Jace Pearson in the late 1950s television series "Tales of the Texas Rangers." The series was based on actual cases of the historic law enforcement agency, and followed a radio series of the same title starring. Joel McCrea in the role of Ranger Pearson. Parker began his career on the New York stage and then came to Los Angeles to make motion pictures.

He had key roles in more than 20 features, among them "What a Woman," "Sangaree" and "Kiss Me Kate." On Dec. 4 in Rancho Mirage, of heart failure. wants to sue. Several American judges ruled that U.S. courts had jurisdiction over the Marcoses after the couple fled their native land in 1986 and settled in Hawaii.

Several lawsuits have been brought under the statute in recent years after advocates of international human rights realized that it could be used by people who had been wronged by foreign officials and might have a better chance of redress in U.S. courts than in their native land. Although several individuals have won such cases, only one has been able to secure a substantial monetary recovery. In another key ruling, the appeals court upheld the procedure used by trial Judge Manuel Real to establish damages. He appointed a special master to conduct depositions and set a benchmark for compensatory damages based on interviewing a representative sample of claimants.

Special master Sol Schreiber interviewed 137 randomly selected claimants and their witnesses in 1994. He evaluated whether the claimed abuse fit into one of three categories- -torture, summary execution or disappearance; whether the Philippine military or paramilitaries were involved in the abuse; and whether the abuse occurred between September 1972 and February 1986, when Marcos was in power. After determining that 131 of the 137 claims were valid, he considered a variety of factors, such as the method and duration of torture, the victim's age, medical bills, the mental anguish of a victim's family and lost earnings in calculating damages. He came up with benchmark figures of $51,719 for a torture victim, $107,853 for an individual who had been "disappeared" and $128,515 for a summary execution. This method yielded total compensatory damages of $767,491,493.

The jury adopted most of the master's findings. The jury also awarded exemplary damages of $1.2 billion, a decision that the appeals court unanimously upheld. The Marcos estate asserted that the compensatory damage procedure was invalid and violated due process of law. Marcos attorney Mark Lane contended that each claimant had to be questioned in order to accurately assess damages. Judges Betty B.

Fletcher and Harry Pregerson disagreed. Although she agreed with her colleagues on other aspects of the case, Judge Pamela Rymer dissented on this issue, saying the process raised "more than 'serious questions' of due process. Even in the context of a class action, individual causation and individual damages must still be proved individually." Judges Fletcher and Pregerson acknowledged that the procedures Rymer objected to were "unorthodox," but they upheld them, citing the case's "extraordinarily unusual nature."
