An attempt by the owners of KKOB-AM and FM to stop the transfer of KNMQ-FM to a new owner has been termed "sour grapes" by the man named as KNMQ's new owner, Steven E. Humphries. "They're really reaching for something to discredit my reputation with the FCC and with the Albuquerque community," Humphries said, charging that KKOB officials are angry because his station lured top-rated morning announcer Phil Sisneros away from them. Attorneys for Fairmont Communications which owns Albuquerque radio stations KKOB-AM and FM, have filed a petition asking the Federal Communications Commission to deny the transfer of the ownership license to Humphries.

The claims listed in the 25-page petition include: Granting of the KNMQ-FM license to Humphries would violate FCC multiple ownership rules because of a 40-mile signal overlap by KNMQ and Grants radio station KLLT-FM, which also is owned by Humphries (the FCC allows same-market ownership for one AM, one FM and one TV station). That Humphries placed KLLT-FM in bankruptcy the same day he closed on the purchase agreement for KLLT. That Humphries and his wife traded air time on the Grants station for merchandise and services for their personal use. He said he discovered another $125,000 indebtedness, and to protect himself from further debts he filed for Chapter 11 bankruptcy reorganization the same day he signed the purchase agreement. "My attorney advised me to back out of the deal," he said, "but I knew the station would be worth at least $1 million if I could move the signal to Albuquerque." On July 27, 1988, after months of declining sales revenues and an inability to win Forest Service approval to build a tower on Mount Taylor, Humphries pulled the plug on the station and removed the equipment and other assets of the building and placed them in storage, he said. The station is now for sale. Humphries acknowledged he and his wife traded air time for personal items and services.

He said this is neither illegal nor an uncommon practice among small market stations. "From the time I took possession of the station in October 1986 until I shut it down in July 1988, I didn't draw any salary, despite the bankruptcy court's approval of KLLT's operating budget, which entitled me to a $5,000 a month salary," Humphries said, adding that the 10 employees of the station received regular paychecks during this time. Humphries said his operation of the Grants radio station has nothing to do with his attempt to purchase KNMQ in Santa Fe. "I lost a lot of money (on the Grants station) and sweat equity. KKOB is trying to make me out as some scoundrel who raped and pillaged this poor radio station in Grants which I just happened to own and which I just happened to place substantial money into." Humphries speculated that KKOB gener- al manager Art Schreiber is angry that Sisneros left KKOB-FM to work for and because a district court judge ruled in favor of Sisneros' move.

Answering the allegation that he took control of KNMQ before the FCC has approved the license transfer, Humphries said the current station owners retained him as a consultant and the consulting agreement was submitted to the FCC on Aug. 3, along with the application of license transfer. As for the hiring of Sisneros, Jack Walrad, one of the current owners of KNMQ, said he had asked Ron Sack, former general manager and currently a part-owner of the station, to try and lure Sisneros to KNMQ two years ago. That in violation of FCC regulations, Humphries took acquisition of KNMQ even though the FCC has not yet approved the transfer of license. If the FCC approves the transfer, Humphries would own 100 percent of the stock of Mesa Grande Broadcasting, current owner of KNMQ-FM, which would continue to operate KNMQ-FM in Santa Fe. Humphries also owns 74 percent of Kapdin Communications, the licensee of KLLT-FM in Grants; 45 percent of Sun Media of New Mexico, the licensee of KALY-AM (formerly KLTN) in Albuquerque; and 100 percent of Sun Media of Colorado, the licensee of KZKS-FM in Grand Junction, and KWWS-AM in Rifle, Colo. Humphries said his attorneys are drafting a response that will be filed with the FCC by Oct.

4. Humphries said the allegation of multiple ownership is moot. The 40-mile signal overlap between KNMZ and KLLT would have occurred only if the Grants station had received permission from the U.S. Forest Service to construct a new tower on Mount Taylor, enabling the signal to reach a farther distance. Humphries said he had wanted to expand the station's signal to give him access to the Albuquerque market.

The Forest Service twice rejected his applications for leasing the land, he said. (Ml MOVIE: Moon Over Miami ('41) Off the Air In terms of TV performance, Dukakis was much more in command of the camera Sunday night (he looked into it when speaking, for one thing), much more in control of his spoken thoughts and far smoother in delivery than Bush. Bush was whiny, rambling and shifty-eyed.

He addressed his answers not to the camera and thus to the viewing nation but to one of the three journalists who asked the questions, or to Dukakis, or to a hole in the wall. Dukakis was winning after an hour of the 90-minute show (televised live from Wake Forest University in Winston-Salem, N.C.) and he hadn't even mentioned Dan Quayle yet. Bush hadn't mentioned him, either, of course. All in all, the debate was much more engaging and lively than viewers had been led to expect. Viewers who watched the debate might not have been filled with political fervor by it, but they might be less inclined to wish that the ballots in November would include a box labeled "Abstain." Predictable scripted zingers were dispatched early.

Bush showed himself incompetent at the kind of symbol mobilization Reagan does so well. No fewer than five times did Bush employ the phrase "a thousand points of light," written for, and effective in, his Republican convention acceptance speech.

Each time Bush uses the phrase, its value decreases. As ABC's wry Jeff Greenfield noted later, Bush still can sound like a fellow for whom "English is a second language." Nevertheless, Bush won a few skirmishes. Dukakis flubbed an answer to Bush charges about goofy positions taken by the American Civil Liberties Union, of which Dukakis is a "card carrying" member. Bush won on SDI because Dukakis said he was skeptical about the program, but that he would spend $1 billion a year researching it anyway. After the debate, NBC rushed back to" Seoul for more of its expensive Summer Olympics Games.

ABC and CBS stayed on with analysis. ABC's was much the pithier. Greenfield noted that whatever the ebb and flow of the debate, Dukakis offered "a far more eloquent close than George Sam Donaldson, ABC News White House correspondent, said wafflingly that "both men did extremely well." He wouldn't declare a winner.
