A6 THE NEWS JOURNAL MONDAY, SEPT. 25, 1989 1 Police close the book on Dover cave-in death Suffocation accidental, authorities say Maries: Former pageant chairman is dead at 76 cause of a clamor from state pageant committees, who did not like abandoning tradition. In January 1980, Marks decided not to renew the contract of Bert Parks, who had been host since 1955. The firing brought considerable criticism, including several nights of ridicule on the air from talk-show host Johnny Carson. In 1982, he dropped the show's famous theme, "There She Is," in a dispute with author Bernie Wayne.

He allowed the song's return in 1985. Miss Williams, the first black to wear the rhinestone-studded crown, also became the first to be forced into giving it up when Marks dismissed her in 1984 after nude photographs of her, taken before her reign, were published in a men's magazine. Amid the controversies, Marks, senior vice president of the investment banking firm Advest Group and past president of the Atlantic City Chamber of Commerce, racked up 11 "Man of the Year" titles from civic organizations. He is survived by his wife, Mary Kay. Funeral arrangements were incomplete.

FROM PAGE A1 national contest with an iron will. He had final say on musical compositions, television production plans, sponsorship contracts and choice of judges. Lawyer Leonard Horn, who became the pageant's first full-time, paid director in 1987 after Marks retired from the job he had held as a volunteer for 35 years, remembered Marks as a strong leader. "He had a capacity for making quick decisions and never looking back," Horn said. An investment broker by trade, Marks joined the Miss America Pageant as an unpaid volunteer in 1952.

Marks went on to become the pageant's director and, for 25 years, its chairman. He brought the show to television in 1954. He defended the pageant when it faced criticism from feminists, the National Association for the Advancement of Colored People, labor organizations and those who consider Miss America an outdated symbol. Marks in the late 1960s suggested that the swimsuit contest be scuttled and that contestants wear sports clothes instead. He said he dropped his proposal be tal, where he had been taken by state police helicopter after the 7 p.m.

accident. Rains from the recent storm had worn two steep gullies into the dirt mound through which Pettit and his brother-in-law were tunneling, said Lt. Gerald R. Pepper a state police spokesman. He said they were trying to 'connect the gullies, with Pettit digging on one side of the mound and his brother-in-law on the other.

"Apparently, what Pettit was trying to do was tunnel through the existing mount of dirt, and in doing so the dirt collapsed on him," Pepper said. Pettit had tunneled four feet into the wet dirt. The youths who were not identified by police tried unsuccessfully to dig him out, then ran to a relative's house on nearby Banning Road, where Pettit had been staying temporarily, Pepper said. A relative went to the sand pit with the boys, then returned home and called police, who dispatched the fire company. The dirt pit is not secured by a fence, Pepper said.

Pepper said the asphyxiation death has been ruled accidental. Arrangements by SPICER-MULLIKIN FUNERAL HOME. By LAWRENCE HARDY Staff reporter DOVER There will be no autopsy or further investigation into the weekend suffocation of a Felton man killed as he tunneled under six feet of wet dirt, police said Sunday. Timothy P. Pettit, 26, was playing with his two 12-year-old nephews and 15-year-old brother-in-law at Bob's Sand and Gravel, trying to tunnel under an earthen mound when the dirt collapsed. "I just can't understand why someone would be back there anyway digging a tunnel of all things," Bruce E.

Shockley, chief of Magnolia Fire Company, said Sunday night. About 20 firefighters, working under floodlights, dug for more than a half-hour with shovels and their hands before freeing Pettit, Shockley said. Rescue crews had trouble finding the site off US. 113A and getting through the dirt piles and mud to reach it, he said. "We couldn't see anything at all when we got there," Shockley said.

"Then one boy showed us where he was. We just dug at that location until we found him."
