FAOtTWO BEDFORD GAZETTE, BEDFORD. FRIDAY, DECEMBER 7, 1945 OBITUARY John McPhillips John McPhillips died at the home of his son-in-law, Merrell Treece, Bedford. Sunday evening abaut 7:15 of a heart attack. He became ill about 4:00 a. Sunday afternoon.

Deceased was born at Dudley May 1. 1872, a son of John and Mary (McHugh) McPhillips. He was married to Mary Madigan McPhillips who preceded him in death. Surviving are the following children: Mrs. Theresa Reed, Dudley, Mrs.

Marie Treece. Bedford: Mrs. Fidelis Geirer and Bernard D. McPhillips, Pittsburgh: stepchildren Clement Frauds Kathryn and John G. Ryan, all of Dudley Also surviving is a sister, Mrb William McGoey, Long Island.

N. Y. Membership was held in St. Thomas Catholic Church, Bedford, and in the Knights of St. George.

Funeral services were conducted Wednesday morning in the Immaculate Conception Church at Dudley, the Rev. Father Conley officiating. Burial was in the church cemetery under the direction of Alton Barefoot, mortician. Mrs. Rebececo Davis Mrs.

Rebecca Ellen Davis died Wednesday evening. Dec. 5, 1945, at her home in Alum Bftnk. She was born at the home where she lived and died. Dec.

1863, a daughter of Peter and Maria (Allison) Rinmger. She married John Davis. Sept. 30. 1886.

Her husband preceded her in death 26 years ago this month. Sh'e was the last member of a family of 18 She is survived by the following children: Mrs. Mary Leppert, Alum Bank, with whom she lived: Oscar H. Davis, Pittsburgh: Mrs. Carrie Hershberger.

Fishertown: Ward R. Davis, Ravenna, Ohio: George A Davis, Altoona; Edwin O. Davis, Fishertown: Harold F. and Robert S. f)avis, Pontiac.

Michigan. Also surviving are 34 grandchildren and 31 great-grandchildren. Three grandsons are in the armed forces. One daughter preceded her in death. Membership was held in the Reformed Church.

Friends may pay their respects at the Geisel Funeral Home, Alum Bank, where funeral services will toe conducted Saturday afternoon at 2:00, the Rev. C. R. Doverspike officiating. Interment will be in the Pleasantville Cemetery.

Shelley William Taylor Shelley William Taylor, aged 18, died at the home of his parents in Hopewcll. Thursday, Nov. 29, of a heart condition. He wab born in Hopewell, March 2. 1927.

Clara (Trail) Gibson, and these brothers and sisters: Elias Gibson of Fresno, Rev. Thomas R. Gibson of Mrs. Ella (Gibson) Showalter of Fresno, Calif. Mr.

Gibson was a member of Mountain City Lodge No. 2tf, Knights of Pythias. Funeral services were held Thursday afternoon with interment in Ml. Olivet cemetery, directed by C. E.

W. W. Twigg and the Rev. Coy Foor officiating. Burial was made in the church cemetery, directed by Balentine funeral service.

George C. Ensley George C. Ensley died at the Everett Hospital, Nov. 26, of complications. Deceased was born Needmore Jan.

2(f. 1868. He was married to Mary Mellott who preceded him in death 32 years ago Surviving are two daughters, Mrs. Sherman 'Dishong and Mrs. Orlen Fix, Needmore: a son, Reuben Ensley, 2 brothers, 3 sisters, 5 grandchildren and 6 great grandchildren.

Membership was held in the Sideling Hill Church for 50 years. Funeral services were conducted Thursday, Nov. 29, at Sideling Hill Church, the Rev. Coy Foor officiating. Interment was at Sideling Hill under the direction of the Sipes Funeral Home.

Mrs. Amanda Shroyer Mrs, Amanda Elizabeth Shroyer, 35. died at her home in Fossilville, near Hyndman. Monday morning after a brief illness. She was born Oct.

2, 1910. a daughter of Oscar Waugerman and Maude Hollei Waugerman, Buffalo Mills. In 1930 she married Walter Harry Shroyer. Besides her husband and parents she leaves two children, Norma Fay Shroyer and Dorothy Louise Shroyer at horhc: three brothers, Dalton Oscar and Waugerman, at home, and five sisters, Mrs. Clyde Leydig, Fossilville; Mrs.

Floyd Hyde Ellerslie and Marva Bohn. Olive and India Waugerman, at home. Funeral services were held at Lybarger Lutheran church, Madley, where, she was a member. Thursday afternoon. The Rev.

Blair Memorial Hospital Monday morning- December 3. He had been admitted to the hospital for an operation and while there suffered a heart attack. He was born in Walker Township on February 16. 1894, son of William Ward Gahagan and Mary Ellen (States) Gahagan. On September 22, 1941, at the Old Stone Church in Marklesburg, he was united in marriage to Grace E.

Eichelberger of Saxton. His only survivors aie his wife arid an uncle, Alex Gahagan of McConnellstown. Mr. Gahagan moved from McConnellstown to Saxton 25 years ago and was employed by the Huntingdon and Bioad Top Mountain Railroad for a few yea is. For the past twenty-two years he had been in the employ of the Pennsylvania Edison Company, serving as assistant turbine operator.

The funeral service was held Wednesday afternoon at the Robert E. Huff funeral chapel in Saxton, the Rev. McKinley Kepler officiating Interment vas made in the I. Cemetery, Saxton. Mrs.

Bertha Gohn Funeral services foi Mrs. Bertha Goldie (Mock) Gohn, 60, who died Ipst Tluusday morning. Nov. 29, at the Timmms hospital, were held Sunday afternoon. Brief rites were conducted at the home of her daughter.

Mrt. Edgar Schroyer, St. Clairsville followed by services at the Fishenown Refoimed Church. Interment was in the Fishertown Cemetery under the direction of the Geiscl Funeral Home. Mrs Gohn was employed at the Timminb Hospital when she was stricken, death being attributed to heart condition.

She was born near New Paris Apiil 5. 1885, a daughter of Charles and Anna (Croylc) Mock. Her husbjnd, Frank Gohn. died in 1936 Surviving are four children--Mrs Schroyer, St. Clairsville; James Gohn and Mrs.

Sarah McKinncy, both of Mathci, and Frank Gohn, Pleasanlville Alho serviving are a brother, Jacob Mock; a sibter. Mrs. W. Harrison, both of Schellbburg, and another bister, Mrs. Archibald Boyle, Johnstown.

John W. Colledgc John W. Colledge of Breezewood, R. died at his home at 4:10 p. Monday, Dec.

3, 1945, of a heart attack. He was born November 10, 1870, a son of Henry and Charity (Wright) Colledge, in East Providence Twp. He was married to Ema- linc Danirk July 25, 1891. He is. survived by his wife; a son, Clarence E.

Colledge, Everett; a daughter, Mrs. Walter Leader, Everett a McClellan Colledge, Breezewood; grandchildren and 4 great-grandchildren. One daughter preceded him in death. Membership was held in the Methodist Church Funeral services were conducted Thursday, Dec. 6.

Jennie Catherine Hosselrode 85, of Hyndman. K' died Wednesday morning, December, 5, 1945, at Cumoerland. She was born at New Buena Vista, a daughter of Jacob and Ann (Cook Feichtner. Her husband, Herman Hosse.lrode, died a few years ago. Her married life was spent at Hyndman.

Funeral services will be held at 2:30 Saturday at the Palo Alto Evangelical Church, the Rev. J. W. Lloyd officiating. Interment will be in Palo Alto Cemetery under the direction of the Zeigler Funeral Home.

Phone 431 AN ORDINANCE ESTABLISHING AND RIQULAf- ING A POLICE PENSION FUND Be it ordained and enacted by the Chief Burgess and the Borough Council of the Borough of Bedford, Pennsylvania, and it is hereby ordained and enacted by virtue of the authority vested in the same as follows: Section 1. There is herewith established a Police Pension Fund (herein referred to as the under authority of the General Borough Act, Sections 1131 to 1136, and any other statutes now or hereafter pertaining or applicable hereto and any ordinances that may be lawfully enacted for the purposes hereof. The Fund shall be created and- maintained by an equal and proportionate monthly charge against each member of the Police Force in the amount of three (3) per centum of the pay of such member and 'also from other sources. The Fund shall be for the benefit of all members of the Police Force who elect to become members and shall be under the direction of the Borough Council.

The officers of the Fund shall be the President bf the Council who shall be President of the Fund, the Borough Secretary who shall be Secretary of the Fund and the Borough Treasurer who shall be Treasurer of the Fund. Section 2. The Fund shall be applied in accordance with the present and future laws, and under such regulations, herein or hereafter, as the council may lawfully prescribe, for the benefit of such members of the police force as shall receive honorable discharge therefrom by reason of age or disability, and the families of such as may be injured or killed in the service. Any allowance made to those who are retired by reason of disability or age shall be in conformity with a uniform scale. For the purpose of this ordinance, unless and until changed by statute or ordinance, a policeman means a full-time paid policeman.

Section 3. Any policeman, as defined, may elect to 'join the Fund by notifying the Borough Secretary in writing and therein authorizing the proper borough authorities to deduct three (3) per centum from the officer's pay as his contribution to the Fund, and in such communication naming a beneficiary or beneficiaries to whom payments shall be made in the event of the officer's death while a member, of the Police Force and the Fund, and further stipulating and agreeing that he shall be bound by the provisions of the law pertaining thereto and of this ordinance and by any future statutes and authorized ordinances pertaining hereto. Section 4. The contribution deducted shall be forthwith deposited to the credit of the Fund, and into the Fund shall likewise be deposited and credited any and all contributions that may be lawfully made by the borough, and the borough council hereby authorized to accept and likewise deposit and credit any and all contributions, revenues or proceeds from any sourse, and gifts grants devises, bequests of money or property, and any sum or sums paid to the borough and inuring to the Fund from any official or department of the Commonwealth of Pennsylvania under any present or future law pertinent thereto. Section 5.

The assets of the Fund shall be kept separate and apart from' other borough funds. Any part of the Fund may be invested in the same manner and in the same kind of securities as sinking funds of the borough may by law be invested. All funds, whether invested or not, shall be subject to such further regulations as the borough council may prescribe from time to time. Section 6. The books and records of the Fund shall be open for inspection by any-interested party, and the accounts shall be audited as council directs.

Section 7. The borough council may formulate rules or by-laws to implement and effectuate the intent and purpose of the statutes and ordinance relating to Police Pensions. Section 8. The minimum period of continuous service after which members may be retired from active duty and be entitled to a pension hereunder, is fixed at twenty (20) years, or such other period as shall be fixed by ordinance pursuant to statutory authority. Policemen so retired shall be subject to serve as Police Reserves until unfitted therefor by age or disability, when they may be finally discharged.

While on duty as a Police Reserve, they shall be paid in wages, in addition to the regular pension, such sum as council may determine. Section 9. (a) Should a policeman be discharged or voluntarily withdraw from service, or otherwise cease to be a member of the Fund, except as provided in Clauses (b) and (c) of this section, he shall be paid from the Fund the full amount of the deductions from his pay, without interest, or the amount may, in the reasonable discretion of council, be paid to his wife, children, or other dependents. (h) Should a policeman not eligible to pension but in good standing in the Fund be honorably discharged because of disability, he shall likewise be paid from the Fund the full amount of the deduct- tions from his pay, without interest, and may, if he shall have been in the service at least one full year be granted leave of absence for one month with pay from the General Fund of the borough. (c) Should a policeman die in service and in good standing in the Fund, or within one year after his retirement on pension, there shall be paid, to his widow, or other beneficiary named by the decedent, or to his family, or in the discretion of the council to other proper persons, including (in proportionate shares) medical and hospital- services during the last illness, or funeral expenses, from the Fund the full amount of the deductions from the Decedent's pay, without est, and in addition there may be paid from the General Fund of the borough, as in Clause (b), an amount equal to the last month's salary paid to the decedent, as an earned leave of absence.

The ments provided in Clauses (b) and (c) are alternative and not cumulative. Section 10. Upon application in writing stating a reason deemed good and sufficient to it, the borough council may fcrant any policeman leave of absence without pay for a period not exceeding six months, unless such period shall be extended by a majority vote of the entire council, during which time the member shall be considered in relation to the Fund as being in active service, and he shall not lose any rights to pensions or benefits hereunder, provided that while on leave of absence he regularly makes a contribution to the Fund in the amount that would be deducted from his pay if he were on active duty. The provision of this section may likewise apply where any member is prevented by injury or illness from performing his regular duties, if he remains a member of the police force and of the Fund; Provided, such leave of absence shall not affect any law, ordinance or action of council providing for sick leave or vacations. Section 11.

Pensions shall be in conformity with a uniform scale to those who after the said twenty years of service retire by reason of disability or age. Tfie basis of the apportionment after the said twenty years of service shall be determined by the monthly pay of the retired member at the time of honorable discharge, disability, or retirement, and shall not in any case exceed in any one year one-half of the annual pay of such member computed at such monthly rate. There shall be no liability on the part of the Borough of Bedford for the payment of pensions or benefits out of any fund other than the police pension fund. Section 12. No person participating in such Fund and becoming entitled to receive a benefit there- from, shall be deprived of his right to an equal and proportionate share therein, upon the basis upon which he first became entitled thereto, except for following causes, that is to say: conviction of a crime or misdemeanor; becoming a habitual drunkard; becoming a non-resident of the Commonwealth; or failing to comply with same general regulation relating to the management of the Fund, or if, while a member of the Police Reserve, receiving a pension, he shall refuse to report for duty and perform the duties prescribed unless in the opinion of council good and sufficient reasons are shown for such failure or neglect.

Should anyone receiving a pension be convicted of dmy crime or misdemeanor or become a habitual drunkard, or fail to support his wife, children or other dependents, then the borough council, after full investigation and hearing, may, in its discretion, make said pension payments to the wife, children or other dependents of said pensioner. Section 13. Any policeman aggrieved by any ruling of actWn of council regarding the Fund and his relation thereto, shall have the right to a hearing before council to be held within ten (10) days of his written request therefor at which he may attend in person and be represented by" council and may further require the attendance of any witnesses on his behalf by subpoena to be issued by the borough council on his written request. Minutes and records shall be kept of testimony and facts produced, and council may thereupon make such order and ruling in the matter as may seem just and lawful. Section 14.

No payments under this ordinance may be assigned or attached in any manner or for any purpose, reason, or cause, or under any circumstances. Section 15. The provisions of this ordinance insofar as they are the same as the statutory provisions, shall be subject to change or repeal in order to comply with any future statutory provisions; and the provisions of this ordinance may be amended or repealed if statutory authority be granted therefor or statutory restrictions or mandates are eliminated and discretion vested in the borough authorities. Section 16. Policemen applyirtg for membership in the Fund shall agree to be bound by the provisions of this ordinance, by any rules or by-laws promulgated by council, and by any future laws or ordinances pertinent to the subject mat-, ter of this ordinance.
