The term is applied to persons cashing winning tickets for others who want to avoid payment of income taxes on their winnings. Winners of more than $600 at racetracks are required to fill out an Internal Revenue Service form when they collect their winnings. Chester Malandrucco, age unavailable, of Havertown, was named in an indictment charging him with presenting to the IRS a false 1099 form filled out at Brandywine Raceway on July 28, 1974. The form said Robert L. Brown of Richmond, was the holder of two winning Big tickets totaling $2,389, but the indictment charges Malandrucco knew he as the winner.

Asst. U.S. Atty. Alan J. Hoffman said a ten-percenter will substitute his identity for that of a winning ticket holder for 10 per cent of the winnings.

The ten-percenter takes the real inner's ticket, puts his own na me on the 1099 form and then gives the money less 10 per cent for his own fee to the real winner. The ten-percenter avoids paying taxes on the winnings he has declared by picking up losing tickets so he can show losses to offset his reported winnings, Hoffman said. Hoffman's office prosecuted about 14 ten-percenters arrested in a raid at Brandywine in 1974. All of those prosecuted cashed tickets and no real owners of tickets were prosecuted, he said. Ten-pf rcenting is punishable by up to three years in prison and a $5,000 fine.
