Nixon is charged with non-support. Resident Judge Frank Speakman and Judge James 9. Carey are hearing the case, which came before them on an anneal from Municipal Court: The state opposed the appeal but its motiton was turned down several weeks ago in a written opinion by the General Sessions Judges. The case was heard in Municipal Court before the jurisdiction ovef non-support actions was removed to the Family Court last July 1. Nixon contends that the decision holding him to periodic payment of money to Mrs, Nixon is no longer justified because of the divorce he obtained in Florida.

The staJte contends Nixon went to Florida in September, 1943, for the sole purpose of getting a divorce, and hence was not establishing a bona fide residence in the state. Nixon, represented by Thomas Knowles, is attempting to show that he intended at that time to establish permanent residence in Florida. The trial was resumed this morning, while Judge Charles L. Terry, and a jury also resumed hearing on another non support case in another courtroom. Other Deaths JOHN J.
