The victim testified last week that TEST AND jury is to begin deliberations today on charges of rape, kidnapping and car theft against Ricky Metcalf, 31, for the alleged assault of a 26'year-old Boston Heights woman in June.

Metcalf, who was arrested in Daytona Beach, a week after the alleged incident and returned to Akron for trial, testified in his oWi defense Monday that the woman now married to his brother, Randy Metcalf voluntarily engaged in sex acts with him. said he intended to return the woman's car. Earlier testimony was that Metcalf had I la the woman's car as collateral for $40 worth of drugs. Metcalf attempted to claim the U.S. Constitution's Fifth Amendment right against self-incrimination when questioned about what had happened to the woman's purse and money.

He was directed to answer the questions by Judge Glen Morgan, who told him that he would not be prosecuted on charges of theft. Metcalf said he spent the money on gas, food and lodging on his way to Florida.
