Salem Broadcaster's Cancer Editorials Bring FCC Probe By A. ROBERT SMITH ategliter-Guard Correipoadeat WASHINGTON (Special) The Federal Communication! Commission has called an Oregon broadcaster to account for a series of radio editorials concerning cancer cures and criticism of local Oregon doctors. The episode involves W. Gordon Allen, who broadcast the questioned remarks over KGAY, Salem, to the discomfort of the Marion-Polk County Medical Society which passed a resolution of complaint and sent it to the FCC here. As a consequence, the FCC last May wrote to Alien for his account of the allegation that he had broadcast material j.

advocating and promoting an untried dietary cancer cure not based on scientific fact, the use of which might seriously endanger the public health and and also that his remarks on the air implied that "doctors are hiding the truth about cancer for selfish economic reasons." Allen, as head of Willamctte-Iand Television, is applying for a franchise to operate Salem's TV channel 3 and thereby become the first TV operator in the state capital. He is opposed in this contest by Oregon Television, headed by crooner Bing Crosby, the company which now operates KPTV, channel 12, Portland. Correspondence between Allen and Ben F. Waple, acting secretary of the FCC, has been placed in the FCC docket file respecting the TV channel case, and consequently could become an issue in that forthcoming contest Hearings between the two contestants begin in December. "AN UTTER FALSEHOOD" "Inasmuch as the broadcasting of programs of this type by Station KGAY might raise a question as to your qualifications to be a broadcast licensee, in view of the close relationship between W.

Gordon Allen, Station KGAY and your corporation (referring to Willamette-land Television, you are requested to furnish the Commission with full and comple'a information regarding the broadcasts In question." Allen replied that it was "an utter falsehood" that he ha. broadcast anything as an advocate or promoter of untested cancer cures. He said the "local medical association seems unduly sensitive" because he publicized the case of a person "who was cured of cancer after local doctors told him he had only a few weeks to live." He said his broadcasts were seven-minute-long editorials aired three times daily in October-November, 1959, and he heard no criticism from the doctors at the time. May 26 the FCC wrote back that Allen had not been "fully responsive" for failing to supply the government a transcript of his broadcasts. Allen said he had no transcripts and demanded to know what the medical society had charged.

"It is a fundamental; principle of United States justice that one be confronted by his accuser," said Allen. He added that the then president of the medical society had told him he had no complaint, but he understood the charge had come from the previous society president, Dr. James A. Seacat, Salem surgeon. Correspondence between Doctor Seacat and the Federal Trade Commission was also placed in the TV file.

The FTC said it had no jurisdiction when the question of advertisements for questionable cancer cures was raised. From Dr. Seacat the FCC secured a copy of a purported transcript of some of the broadcasts. Allen, upon request, acknowledged its essential accuracy. The transcript quoted Allen as saying in one broadcast: PAY.

FOR REMARKS DENIED "No matter how loud the MD members protest here in Willamette land, it will be our policy to tell the truth from responsible reference sources and also from people who have been cured." Allen went on to tell of a Sweet Home woman whom he said was cured of cancer in a Texas clinic. After her experience had been aired, he was quoted as having said: "Well, there you have another person who is alive today because she refused to die by the accepted, proved and promoted methods fostered by the government and the AMA methods." Allen denied that he had been paid to make any of his remarks a question raised by the medical society and put to him. by the FCC. As for offering local doctors an opportunity for rebuttal on his radio facilities, Allen said he had invited them to step forward but had not heard from "a single i doctor or medical group." In one of his letters of justification to the FCC, Allen said his facilities over the years have given many hours of free broadcast time to the customary appeals for cancer fund drives. In his broadcast, Allen was quoted as saying: "The American Cancer Society, we believe, is so controlled by men whose motives we can only suspect, that we no longer cooperate with this group that effectively conceals where its money goes." In his last letter to the FCC, July 7, Allen protested that he had never mentioned by name the local medical society but that now it had "run behind our backs to the FCC with a false attack in hopes, it appears to KGAY, to have the whole matter erased from public ears.

This, to us, is not candid and open discussion."
