Reno Gazette-Journal Wednesday, November 6, 199138 State, federal officials feud over waste storage at Test Site of "mixed waste" at the Nevada Test Site. The state Division of Environmental Protection sought disciplinary action against the U.S. Department of Energy after learning such waste was being shipped to the site in 1989. Mixed waste is a combination of radioactive and hazardous waste. In 1988, 1,640 barrels of the waste were shipped from the Lawrence Livermore National Laboratory in California to the Test Site.

The waste included gloves, boots and bottles that may have contaminated by radioactive materials. The waste is stored in 55- gallon drums on a pad at the Test Site. During a hearing here Tuesday before the state Environmental Commission, attorneys for both sides agreed to try to negotiate a limit on the amount of waste that can be stored at the site. Commission Chairman Mel Close recommended the limit be placed at the existing amount of 1 50,000 gallons, but DOE officials want the amount at 300,000 gallons. If the two sides reach a settlement, the Environmental Commission will not have to act on the Environmental Protection Division's move to discipline the federal agency.

Deputy Attorney General Brian Chally, who's representing the state, said Nevada also wants the DOE to set up a time schedule for the eventual removal of the waste. "We don't think they can do it immediately, but that's something we'll look into," he said. "We think it has to be disposed of sooner or later. The biggest problem is where to put it." The DOE eventually wants to ship the waste to a Carlsbad, N.M., facility. But the waste could not be shipped to the facility until the late 1 990s at the earliest.

Chally said the state also wants the Environmental Commission to uphold the state's authority to regulate hazardous wastes, including wastes stored at the Test Site. Chally contends states and cities were given such jurisdiction under a federal law passed by Congress. He said Colorado's authority to regulate hazardous wastes at the Rocky Flats weapons facility was upheld by a court ruling. "Our position is that they (DOE) should have come to us for approval before they built a huge CRIME new storage pad in 1987 and 1 988," he said. "DOE chose not to comply with the law." But DOE attorney Sharon He-jazi disagreed, saying federal law gives her agency the sole authority to regulate the storage of mixed waste at the Test Site.

"None of Nevada's laws mention mixed waste, let along byproduct waste," she said. She said that any agreement with the state first must be approved by DOE Secretary James Watkins. The matter will be considered by the Environmental Commission at its Dec. 4 meeting in Laughlin, Nev. At issue: A combination of radioactive and hazardous materials.
